The Job Search Market in Bad Economies

I had a discussion yesterday with a manager of Legal Authority, my favorite job search company for attorneys, about exactly what happens in the market when there is a recession. Specifically, what occurs in the job market for attorneys–who gets hired and who does not get hired. Since I have been witnessing this process in place for years I thought understanding the dynamics of this would be instructive.

On its most basic level, what happens is job in the legal community involving transactional work slow down for the most part and jobs involving litigation speed up for the most part.

Jobs in general corporate, securities and real estate typically slow down dramatically. Patent law can also slow down but there is typically a larger “lag” in the time it takes to slow down. Jobs in trademark also also tend to stop or slow down because this work is something that is typically done when lots of new businesses are being started. Real estate slows down because people are not doing as many large purchases and being more careful with the work they give out. Corporate slows down because companies are more careful about giving out work. Patent work in the system (”in stream”) continues but new patent work is much slower to enter law firms. This results in a delay in the slow down of 2-3 years before attorneys really begin to notice the slowdown in work.

With respect to litigation, this tends to increase a little bit. When the economy gets bad people are much more aware of potential losses in their business dealing caused by the wrongdoing of other parties and they sue.

This is a very general summary of what occurs in the market when it gets really bad and it is exactly what it going on now.
