Firm Sues Nintendo For Patent Infringement

Hillcrest Labs alleges that Nintendo violated patents relating to a handheld three-dimensonal pointing device.
The company said that it holds 29 patents relating to that technology.
"While Hillcrest Labs has a great deal of respect for Nintendo and the Wii, Hillcrest Labs believes that Nintendo is in clear violation of its patents and has taken this action to protect its intellectual property rights," the company said in a statement.
Nintendo had no comment on the litigation.

A microphone that rests atop your TV or center speaker. Ignoring the potential sound issues -- here's hoping this thing has really good noise cancellation -- I've been wondering what a person is to do if their intent is to play quietly. Are gamers really supposed to shout at their televisions during a post-midnight frag-fest? I've got a wife and kids upstairs who will definitely not support that.I get the whole family play thing, although I really don't believe it will inspire parents to communicate with their kids' friends in a game of Animal Crossing. But it seems to me that Nintendo has once again developed a piece of hardware from an island, thinking primarily of itself.
Halo 3. Gears of War. Call of Duty 4. Grand Theft Auto 4. All very successful online games. I don't think any one of them would be made better using a voice-chat solution that encouraged you to speak at high volumes across your living room.
Call me a skeptic. I want to thoroughly test WiiSpeak for myself before I'm convinced the microphone is anything to be excited about.
What also concerns me is that in its sometimes-warped wisdom, Nintendo believes that millions of gamers out there want to play Mario Kart with a plastic steering wheel (and so it comes packed with the game), and yet apparently it doesn't believe that Wii owners want to communicate online. WiiSpeak is sold separately from Animal Crossing: City Folk. So, $49 for the game and $30 extra for the microphone -- $80 to yell at your friends.
The good news is that a third-party hardware maker can probably very easily make a proper headset for Wii owners. The potential bad news is that it may still go unsupported by the majority of titles since Nintendo itself is setting a very poor example.

Our editor-in-chief has just sent along some information fresh from Nintendo's presentation at the GameStop manager's conference in Las Vegas, where the Big N has been discussing Animal Crossing: City Folk and its Wii Speak peripheral. For those of you excited about yet another fruit collecting simulator, we can now reveal how much cash you'll need to scrape together.According to Nintendo's presentation, City Folk and Wii Speak will be bundled together for $69.99 when it ships this November. Unfortunately, this is the real world, and you can't sell apples to a raccoon until you have enough money. If life was like Animal Crossing, things would be much easier. Although I'd then have to deal with pink chipmunks calling me Sparkles.
Sorry, I got sidetracked. This is what happens when Nick Chester demands I write a breaking story when I'm trying to look at Rouge The Bat por ... uh ... yeah. Animal Crossing: City Folk has a price now. Concentrate on that while I close all these tabs on my browser.

There are literally over a dozen AAA Co-Op titles coming out from now until the year's end. While most of them have the moniker of "2" after the title, there are a handful of fresh new franchises on the rise. We've listed our top 5 most anticipated co-op titles for the rest of the year. 5. Fable 2 (360, Lionhead/Microsoft, October 21st)
Co-Op Experience: 2 Player Online and Offline Co-Op
While the original Fable may have over promised and under delivered, Fable 2 is going to do it's best to live up to the hype. On the co-op side of things, this game takes a unique stab at it. As you play the game you will come across spheres that represent you friends and where they are in the game. You walk up to the sphere and you can join their adventures and take on the trials together. When you want to leave you can easily go back to your campaign. It also sounds as if the visiting character will affect the host's world unless a safety feature is turned on. Your dog will unfortunately not come with you.
4. Resistance 2 (PS3, Insomniac/Sony, November 4th)Co-Op Experience: 8 Player Online Co-Op
This sequel comes to us with an 8-player co-op mode whose story differs from the single-player story. There are numerous character classes to choose from, all of which you can level up and unlock weapons and skills. (ala CoD4) The game will also feature full drop-in/drop-out support with scalable enemy difficulties based on the number of players. There will be some fierce competition between this and Gears of War 2, which releases a few days after.
3. Rock Band 2(360/PS3/Wii/PS2, Harmonix/MTV/EA, Sept 14th 360, October 19th others)Co-Op Experience: 4 Player Online and Offline Co-Op
Everyone's music game darling comes around for a second wave and this time it you'll be able to go through the World Tour section of the game with three other people cooperatively ONLINE. The biggest discerning feature for Rock Band 2? Almost all of the previous game's song will be backwards compatible, so if you own RB1 you can import you songs into 2 for $5. Also, all of your downloadable content will work the day you turn the game on. No doubt this will be a huge year for music games and now the instruments should be cross compatible as well.
2. Gears of War 2 (360, Epic/Microsoft, November 7th)Co-Op Experience: 2 Player Online/Offline Story Co-Op and 5 Player Online Co-Op Mode
The original Gears of War brought the absolute best co-op experience to date on the Xbox 360 (just look at the ratings on this site for it). So it's no surprise we have high expectations for the latest title from Epic Games. Once again you'll be provided with a tightly integrated drop-in/drop-out 2-player co-op story mode. New this year is the addition of the 5-player co-op Horde mode where you face off against increasing waves of enemies together. It is just too bad there isn't 4-player co-op through the campaign, but the Horde mode should tide us over.
1. Left 4 Dead (360/PC, Valve/EA, November 20th)Co-Op Experience: 4 Player Online Co-Op - 2 Player Split Screen on 360 Version as well as 4 Player Online.
This is the one game that was on everyone's list this year. Sporting a 4 player co-op story mode in which players attempt to survive the zombie onlsaught, Left 4 Dead has an atmosphere that is like no other game to date. The game was designed from the ground up for co-op play, and it's essential to use tactics and teamwork to survive. Even the game's vs. mode which allows 8 players to play online together has strong ties to co-op. After E3 and PAX this year, it's easy to see why this is our number one anticipate co-op game of the year.
Notable Mentions:
Guitar Hero: World Tour (Multiple Platforms, Neversoft/Vicarious Visions/Activision Blizzard, October 25th) - Guitar Hero's first foray into multiple instruments, can it survive the jump?
LittleBigPlanet (PS3, Media Molecue/Sony, October 21st) - It's yet to be seen just how much game is in LBP.
Red Alert 3 (PC/360, EA October 27th, 360 Novemeber 11th) - An RTS where every mission is designed to be played co-op. Risky.
Saint's Row 2 (360/PS3/PC, Volition/THQ, October 14th) - Open world and goofy, drop in and drop out throughout the entire campaign. You can also dress as a hotdog.

Wii Speak Gets a Dedicated Channel

October 2, 2008 - Consumers that purchase the $30 Wii Speak microphone peripheral for the Wii will be able to immediately use it for more than Animal Crossing, according to Nintendo.
The microphone comes with a code that unlocks the Wii Speak Channel, a chat system for the Nintendo Wii.
Up to four players can chat together on the Wii Speak Channel at no charge.
The user's selected Mii appears in the channel, mimicking the user's mouth to make it appear as if the avatar is speaking.
The channel also allows user to leave audio messages to other users, as well as make audio captions for their stored photos.

Yes, that's right! Nintendo fans can start laughing at Xbox, and PS3 owners. You can now in fact mod your Nintendo Wii to play PC games. Of course it comes with the risk of never being able to use the actual Wii interface ever again. The basic idea is that you can fit the parts of your PC into the case of a Wii. Technically its not a Wii anymore, but hey, who's going to know? Now all you got to do is put up the Wii interface as your desktop, invite a few friends over, throw in Crysis, and amaze them for life!Source

Sony fined $18.5 million in patent infringement case

Over two years ago, Agere Systems filed a suit against Sony for potential infringement on patents regarding "wireless local area network apparatus." Looks like the courts ruled in Agere Systems' favor. Sony has been fined $18.5 million for use of the technology in their devices, such as the mylo and PSP. The jury ruled that the patent infringement was willful.Source
NXE Netflix streaming loses Sony's Columbia Pictures movies
We've reached out to Microsoft for a full explanation -- so keep your fingers crossed that this is just a launch period mishap (like someone flipped the wrong switch ... or something). We're betting on licensing issues, though, which could further cripple the service. Currently, there's no way to tell if a title is excluded from Xbox streaming until it's added to the Queue (reminder: this can only be done from a separate computer). We're not much for statistics, but we can tell you that 13 of 110 items in our Instant Queue are now unavailable, all of which are feature films. The blackout seems to have hit a range of flicks, from: Superbad to Bad Boys; Drunken Master to the entire Karate Kid trilogy (that's right -- the entire trilogy! We don't count that Next Karate Kid noise). We'll update when we learn more.
Update: We've found a common thread! All of the affected titles from our Queue are distributed by Columbia Pictures. Columbia Pictures, of course, is owned by Sony Pictures Entertainment, a subsidiary of Microsoft rival Sony. Case closed?
Oddly enough, Sony Picture Entertainment movies (listed here) are still Xbox-enabled.

Update 2: It appears that the sudden yoinking of Columbia Pictures films from NXE Instant Queue access is a licensing issue with Sony after all. MTV Multiplayer pinged us with word that, on the rental service's official blog, Netflix corp. communications VP Steve Swasey writes:
"As watching instantly becomes a more prominent part of the Netflix service, our goal is to have all of our streaming content licensed for all of our partner devices. We're doing well in this area, but it will take some time before we fully achieve that goal. Today, titles regularly come in and out of license and there is a natural ebb and flow to what we have on license at any given point in time. In the case of Xbox 360, a few hundred titles are temporarily unavailable to be streamed via the Xbox game console. Those titles are still available to be watched on subscribers' computers and on TVs via other partner devices, and we hope they'll be licensed for Xbox 360 shortly."

by Mark BozonNovember 20, 2008 - I've touched on the idea that there are two "Square Enix" companies out there and this is another perfect example of that. On one hand, you've got the Final Fantasy III, Final Fantasy IV, The World Ends With You publisher mentality, where the company is aggressively remaking classic games, pushing original content, and cleaning up because of it. On the other hand, you've got the still very successful, still very quality-driven publisher strategy, which games like Front Mission 1st , Dragon Quest IV, and the now Chrono Trigger remake take, using 95% of a game already finished (or a basic port away from), and then delivering it repackaged to a new crowd of gamers. That doesn't stop these games from being any better quality-wise, but it certainly drops the incentive for returning buyers that have been with Square since the beginning, played it all before, and are now wondering why they're paying top dollar for a game they had over a decade back.
Case in point: Chrono Trigger DS. It's a port of one of the greatest games of all time, adds more options and user-determined design elements based on touch, buttons, and so on, and it's also a game I can't make blanket statements about and recommend for 100% of the crowd out there.
Don't get me wrong. If you haven't played Chrono Trigger before, are in the mood to play it again, or simply feel you need to own this one to support Square's release of such an amazing game, by all means buy it. Just know that most of what you'll find was either included on Super NES years back, or in the PSX Final Fantasy Chronicles seven years ago. For this review we've done something special, as I played through the game again on DS, having already enjoyed the hell out of Chrono Trigger back on Super NES, but we've also got the opinion of someone that's never touched Chrono Trigger before in our "Another Take" section. First off though, I'll give out my two cents.
Really what it comes down to is whether or not Chrono Trigger holds up on DS, both in the whole "adding touch and dual screen" side of things, and also in the fact that this is a game that came out in 1995. It does. It does in a bit, bit way. This was, still is, and I'd imagine will forever be a game that stands the test of time, and given the platform it's a game that still stands out graphically, even now performing better than most 2D efforts on DS. The storytelling is beautiful, the gameplay is turn-based and filled with both random battles and user-initiated ones, but the flow of it all is one that keeps things moving and entertaining throughout, and more than anything else it's just a game that feels amazingly alive, be it from tracking what players do and in what order to deliver a compelling court scene during the game, adding in race modes for future levels and a game kick-off festival to just run around in and enjoy. It's all still just as captivating and touching as it was the first time I played it; a true gem of our industry.
And it's really more than just a "quick port" in the end. Yes, you'll find the same art assets, character designs, animations, and effects, but there's also a much stronger script this time overall (impressive, since the original was so imaginative on its own), and a few added aspects of the game for players who have gone the distance with this one before. The extra quests in the game connect extremely well, with of course of those acting as the 13th ending in the game; and it's a great one to be sure. As far as the multiplayer arena goes, it's fun, but not something that's really needed, or the actual "multiplayer" experience we could have had with Chrono Trigger. Training monsters and battling them with friends is a neat idea - though it's a shame that you'll only find local multiplayer, considering how simple the whole battle mechanic is in this game - and the tie-in between normal story mode cash and the rare items you can take back with you through the monster battling is a nice link, though again not a needed one. A multiplayer co-op experience would have blown me away, and while that isn't what players are going to get with this very simple Monster Rancher meets Pokemon feel, it's still a fun, totally optional offering.
