COPYRIGHTS...is it stealing when you want to use an image?

Yes it is, and here is why!

Because of greed! They figure it is fast and easy to steal off the internet or a magazine and make something with these items to sell....you can not sell or use for profit copyrighted items for your own personal gain...so contacting the originator, YOU MUST GET PERMISSION for usage.

People who take without consent are lazy and cheap, and feed off of others very hard earned success.

It is illegal to steal artwork or photography from the internet or anywhere else to use for your own profit without permission. There are offenders who own internet businesses, home business and sellers for T-Shirts, postcards, greeting cards, cross stitch, embroidery, switch-plates, picture charms, plaques, pillows, prints, rubber-stamps and many more items. Sadly many artists are also doing things like this, using professional photographers images without permission, Photoshopping them to look like paintings, calling it their own original art creations.

One of our fellow members had a painting duplicated and we found it on ebay, she bought the painting for legal proof, she then went to her local radio station where the story aired. It was a popular subject...you can go here to read or listen to the story:  equine art fraud

The bottom line is, respect those that have created something artistically, whether it's an image or an item. You can not take something that does not belong to you, there is a copyright LAW.   When you see the copyright notice and or the © logo you must respect it, even if there isn't a notice - you can not take something without permission...the creation belongs to someone else.

theft of our livelihood. With such an unguarded venue to sell wares,
infringers abound. Our groups main mission is to work with ebay and VERO to get the selling accounts of copyright infringements suspended from Ebay for life, and also to collect and share information that can facilitate our members in lawsuits against these sellers...

The motivation factor for organizing a group of artist's and photographers of equine art to put a stop into the stealing off the internet copyrighted artwork and photography.

It began with a fellow Equine Art Guild (EAG) member Sherrie Engler, who had her artwork, design and layouts stolen on ebay, even her HTML codes. Because the offender ignored Sherries warnings, she went on a warpath to shut her down or Vero her on ebay. Sherrie contacted me and Sheri Gordon (originator of EAG) and asked if we could get together with a plan of organizing a group to monitor ebay and the internet for copyright infringing.

Sherrie designed the EAPL logo (by the way this logo was stolen for embroidery and we caught the person).

Our members have grown to about 140 members, some have had their images taken and manipulated in Photoshop or painted to resemble an original painting, quite a few of these done in China, yes, they are the biggest offender, whether on ebay or a starving artist show at a Motel, they outright steal the image and reproduce it in paintings. China does not adhere to our copyright laws, however they post the copyright notice on their websites, an oxymoron.

If you find the artwork from China on ebay attractive, ask yourself "is this stolen?" Most likely it is, and when you buy it, you hurt the original artist and support illegal Chinese sales.
Here are examples that appeared on ebay, these are copies of Elin Pendleton(an EAPL member) artworks...shown in the picture on the left side are the stolen ones, the right side are the originals...(unfortunately these are very small images) one being a Chinese copy the other looked like it was lifted off her website, they did not even take her name off. This can happen to any artist on the internet or from magazines, books, or anywhere you have your art printed...the best thing to do is save the image in a small format and or use a copyright logo on the image. Of course if someone wants it bad enough they will not be bothered with either, as was with Elin's art. Be diligent and watch the internet and ebay for your artwork. The best way to do this, is to apply for membership at the Equine Arts Protection League where this type of activity is monitored.

Flickr Photos a disturbing trend

some claiming to be originals, are just ripoffs!

I have been to Flickr and there seems to be a trend of illegally claiming photos. Flickr has so many wonderful photo images, it is amazing talent, however there are quite a few people claiming to be the original photographer, and they just are not! We have given notices to our photographer members at EAPL, where they have found their own images taken illegaly and claimed. Our members have contacted other photographers to see if they recognize their own images. Our photographers have asked nicely for the removal within a time period and if this has not been done legal action has been taken.
You CAN NOT take without asking, it is called copyright infringement, whether photographs or artwork.
I do enjoy seeing the backyard photos, the joy of showing and sharing with others is fun.

China is the worst offender...

There will be those that don't agree and don't care, but it's good to know there are organizations now that search out copyright infringing.

    Copyright is a law for a reason, and it is absolutely not right to steal, no matter whether the photo is copyrighted or free to use. IMO, all photos and creative works should get the recognition it deserves.

    I had a friend once who copied Betty Boop and put the images on her painted glass decor. She was at a craft fair and DISNEY representatives came by and slapped her with a lawsuit. She wound up paying around $1500. as close as I can remember. A true lesson. Great lens.. angel blessed!

    Oh Wow she got off easy! Big companies are really strict, I see infringements all the time, it's never ending...especially the ones from China, matter of fact I just found an artist friends painting being copied in China and sold on eBay.

    someone wrote me an e-mail asking me if my photo from internet could be used for a poster. i said to myself, this is just a hoax and i did not reply because there are lots of spam e-mails cruising around.

    Respecting copyright protection for images and for text is very important. If a person would not think of stealing a shirt off the rack in a store, why would they think it's ok to steal a photo off the internet?

    I think they reason that if they take a shirt off the rack, the owner will be missing a shirt. But if a person steals a photograph, the owner still has it. So they don't see the harm. I try to explain that when they steal a photograph, they deny income to the person who owns the photograph, because the stolen photograph doesn't generate sales for the owner. Fair use also confuses people. If someone uses a photo for educational purposes, it may be legal. Fair use limits the amount of someone's work you can use. You can't steal a whole book, but you can reprint one chapter for your class. How do you take just a portion of a photo? It's not always clear when the theft steps over the line from fair use into theft.

    Thank you for writing this lens. I do not like to use copywrited material without permission. It is so easy to ask sometimes, too. I used a cartoon by Dave Coverly on my "Best Fiction Reader's" lens with his permission. He was quite gracious when he emailed me back giving me the go-ahead.

    Thanks for campaigning against the theft of images. It's a serious problem. I've had a photo stolen and know how upsetting it can be. I'd hate to have my artwork stolen in this way.

    Is it illegal to put someone else's picture on your web site? Example: someone has a fan site about a tv show, they want to put picture's of the actor's, show, ect. can they borrow those pictures to post on there site? There not going to sell it but they will be making money off advertising. So is that illegal? if you can answer my question on my home squidoo page i would appreciate it. thank you
