Yes it is, and here is why!
Because of greed...they figure it is fast and easy to steal off the internet or a magazine and make something with it to sell "YOU MUST HAVE PERMISSION "from the originator. People who take without consent are lazy and cheap, and feed off of other's very hard earned success.
It is illegal to steal artwork or photography from the internet or anywhere else to use for your own profit without permission. The offenders are your internet businesses, like home business sellers for T-Shirts, postcards, greeting cards, cross stitch, embroidery, switchplates, picture charms, plaques, pillows, prints, rubberstamps and Photoshop manipulations, actual paintings and many more items. Sadly many artists are also doing this, using photographers images without permission, calling it their original art creations.
One of our fellow members had a painting duplicated and we found it on ebay, she bought the painting for legal proof, she then went to her local radio station where the story aired. It was a popular subject...you can go here to read or listen to the story: equine art fraud
The bottom line is, respect those that have created something artisticly, whether it's an image or an item. You can not take something that does not belong to you, there is a copyright LAW. When you see the copyright notice and or the C logo you must respect it, even if there isn't a notice you can not take something without permission...the creation belongs to someone else.

Say "NO!" to the Orphan Works Act"
IMPORTANT NOTICE!
PLEASE, WE MUST ACT NOW...
As an artist YOU will dread it if this is allowed to pass.

- Orphan Works: A New Call to Action
PLEASE SIGN NO to Orphans Works Act.
..........IMPORTANT.......... PLEASE READ BELOW!
From the article:
If the Orphan Works legislation passes, you and I and all creatives will lose virtually all the rights to not only our future work but to everything we've created over the past 34 years, unless we register it with the new, untested and privately run (by the friends and cronies of the U.S. government) registries. Even then, there is no guarantee that someone wishing to steal your personal creations won't successfully call your work an orphan work, and then legally use it for profit.

EAPL
EAPL MISSION STATEMENT
and how our organization of EAPL started
Members of this League will find strength in numbers within a community
that bands together to enforce their copyrights in online venues such as eBay.
The Equine Arts Protection League is free to join. Our only requirement
is that each member join the members board which is found at:
http://groups.yahoo.com/group/eapleague
At this time Ebay is the primary venue that many of us have experienced
theft of our livelihood. With such an unguarded venue to sell wares,
infringers abound. Our groups main mission is to work with ebay and VERO to get the selling accounts of copyright infringements suspended from Ebay for life, and also to collect and share information that can facilitate our members in lawsuits against these sellers...
The motivation factor for organizing a group of artist's and photographers of equine art to put a stop into the stealing off the internet copyrighted artwork and photography.
It began with a fellow Equine Art Guild (EAG) member Sherrie Engler, who had her artwork, design and layouts stolen on ebay, even her HTML codes. Because the offender ignored Sherries warnings, she went on a warpath to shut her down or Vero her on ebay. Sherrie contacted me and Sheri Gordon (originator of EAG) and asked if we could get together with a plan of organizing a group to monitor ebay and the internet for copyright infringing.
Sherrie designed the EAPL logo (by the way this logo was stolen for embroidery and we caught the person).
Our members have grown to about 140 members, some have had their images taken and manipulated in Photoshop or painted to resemble an original painting, quite a few of these done in China, yes, they are the biggest offender, whether on ebay or a starving artist show at a Motel, they outright steal the image and reproduce it in paintings. China does not adhere to our copyright laws, however they post the copyright notice on their websites, an oxymoron.
ILLEGAL CHINA COPIES
how you hurt the U.S. Artist by buying illegal China Art
If you find the artwork from China on ebay attractive, ask yourself "is this stolen?" Most likely it is, and when you buy it, you hurt the original artist and support illegal Chinese sales.
Here are examples that appeared on ebay, these are copies of Elin Pendleton(an EAPL member) artworks...shown in the picture on the left side are the stolen ones, the right side are the originals...(unfortunately these are very small images) one being a Chinese copy the other looked like it was lifted off her website, they did not even take her name off. This can happen to any artist on the internet or from magazines, books, or anywhere you have your art printed...the best thing to do is save the image in a small format and or use a copyright logo on the image. Of course if someone wants it bad enough they will not be bothered with either, as was with Elin's art. Be diligent and watch the internet and ebay for your artwork. The best way to do this, is to apply for membership at the Equine Arts Protection League where this type of activity is monitored.
Flickr PHOTOS A DISTURBING TREND
claiming to be original photographs, are just ripoffs!
I have been to Flickr and there seems to be a trend of illegally claiming photos. Flickr has so many wonderful photo images, it is amazing talent, however there are quite a few people claiming to be the original photographer, and they just are not! We have given notices to our photographer members at EAPL, where they have found their own images taken illegaly and claimed. Our members have contacted other photographers to see if they recognize their own images. Our photographers have asked nicely for the removal within a time period and if this has not been done legal action has been taken.
You CAN NOT take without asking, it is called copyright infringement, whether photographs or artwork.
I do enjoy seeing the backyard photos, the joy of showing and sharing with others is fun.
Please note: the images below are chosen randomly by Flickr, I have no control which ones show up each day...this article does not claim that "all Flickr images" are copyright infringements, however there are "some on the site." The Flickr here only advertises its site.

China is the worst offender...
There will be those that don't agree and don't care, but it is good to know there are organizations now that search out copyright infringing

I always give credit for the images I use and try to use those listed with a Creative Commons license on Flickr. Sometimes the exact thing I want doesn't have a CC license, though, and I use it anyway with the image linking straight back to the person's page as well as written attribution. I think people don't know about the CC license so they don't use that option when posting images. I'm an artist, too, so I'm on both sides of the fence sometimes. 5*

Interesting! Copyright is really a sticky issue. The fear of copyright infringement destroys creativity. Paintings, books, sculptures, designers creations, etc definitely are copyrighted and should never be stolen, but how about a friend's photo, clipart or a picture off the internet that you don't know about? Sometimes it is not clear. Good lens.

I whole-heartedly agree with you. Stealing is stealing, plain and simple. I use a lot of images on my lenses, and do my best to make sure they are either public domain or creative commons where I can link back to the owner, as far as screen-shots, I include a disclaimer stating who the copyright belongs to. There was an instance where I had an image that belonged to someone else, and they contacted me and nicely told me of my error. I felt like a thief, and changed the image to honor their ownership, and all was fine. It is terrible that people do this on purpose! 5 stars
