Avoiding Unwanted Contacts with the Police by New Hampshire Lawyer Mark Stevens 603-893-0074

Road-blocking season is upon us again. As the holidays approach, I posted an article on my main blog about avoiding unwanted contacts with the police on holiday weekends, one aspect of which is keeping those inspections stickers up to date on all your personal vehicles. For a link to that article see below:

http://www.byebyedwi.blogspot.com

it is more important than ever to keep your inspections stickers current. An expired inspection sticker is one of the most common reasons police stop a motor vehicle. The driver usually isn't speeding, weaving or doing anything else wrong. The stop isn't made because the police have a burning desire to see if the equipment on your car works. This stop often leads to other issues for the driver, like a DWI arrest, arrest for operating after license suspension or revocation, or operating after habitual offender certification. Keeping your inspection sticker current is one of the many ways to minimize your chance of an unwanted encounter with a police officer. This would be a great New Year's Resolution to make to yourself: keep your inspection stickers and registrations up to date. They are the cause for numerous unwanted interactions with the police.

Avoid Unwanted Police Contact By Keeping Your Inspection Sticker Valid

Check Your Inspection Stickers and Registrations by Mark Stevens 603-893-0074

An important reminder before you start driving is to make sure that your car has a valid inspection sticker, as well as a valid registration. If you drive into a roadblock, which is becoming more likely each week in New Hampshire, or even drive by the police without a valid inspection sticker you can count on being stopped and hassled.

I have copied below a copy of the New Hampshire law on inspection stickers. Like all the motor vehicle code, the police often co-opt this law to stop you to see if you have been drinking or have drugs in your car. As you can see, the penalty for a violation of this section of the motor vehicle code is $60, but a much greater penalty is when the police smell alcohol or suspect that you have been drinking after stopping you for the lack of an inspection sticker.

Many drivers who are initially stopped for this minor violation end up charged with DWI, DUI or OUI. AVOID one potential for this by making sure your inspection stickers are up to date. For information about New Hampshire DWI laws also feel free to visit my website at:

Here is a copy of the law:

TITLE XXI Motor Vehicles
CHAPTER 266 Equipment of Vehicles Inspections

266:5 Penalty for Failing to Obey Inspection Requirements.

The driver or owner of any motor vehicle failing to comply with the requirements of the director relative to inspection shall be guilty of a violation, and the director may refuse to register, or may suspend or revoke the registration of, any motor vehicle, trailer or semi-trailer which has not been inspected as required or which is unsafe or unfit to be driven; provided, however, no person shall be charged with a violation of this section until a period of 10 days has elapsed from the date the inspection was due. This section shall not apply to those vehicles required to be inspected under the provisions of RSA 266:1, IV. The fine for a violation of this section shall be $60.

Have a safe weekend,

Law Office of Mark Stevens http://www.attorneymarkstevens.com/ If you have just been arrested for DWI you have probably just spent the worst night of your life. You have been subjected to a battery of roadside gymnastics, handcuffed, humiliated and embarrassed. You have wondered whether your name will be in the paper. You have wondered whether you will be fired when your boss finds out about this. You may have had to call a loved one to pick you up at the police station in the middle of the night. The next critical decision you have to make is whether to get a DWI defense lawyer. The United States Supreme Court has noted repeatedly that misdemeanants who have counsel tend to fare better than those who do not. In Argersinger v. Hamlin, 407 U.S. 25, 35-36 (1972) the Court found that misdemeanants with attorneys are five times more likely to have charges dismissed as misdemeanants without counsel. This is great advice from Mark. I am amazed at the number of people that are arrested for DUI after being pulled over for non moving equipment violations.
