- Simply, no. It's common for the police to leave the hospital without arresting you. However, it is mandatory that they obtain a sample of your blood before they leave. Your blood will then be sent to the crime lab where they will determine whether you were under the influence of alcohol (.08) or drugs. If they determine you were, the prosecuting agency is likely to file DUI charges, in which case you will receive a summons to appear in court.

- I was in a car accident last week. When the police arrived, they took me to the hospital, but after about an hour they left. I was not arrested, even though I had been drinking that night. Does that mean I don't have to worry about getting a DUI?
