Identity theft is a crime that can take years to discover. It often affects the credit score of the victim if the offender has stolen a credit card or other financial information.
This crime affects everyone from grocery store employees to the highest level of government. Most recently, vice-presidential candidate Sarah Palin was the victim of identity theft, at the hands of someone who had a political agenda. Palin's private Yahoo e-mail account was hacked, and some of its contents were posted on the Internet.
A group of hackers, known as Anonymous, took credit for the intrusion, and published screenshots of e-mail messages and photos belonging to Palin on WikiLeaks. The son of a major Democratic politician was charged with the crime and faces serious consequences as a result. These crimes happen to celebrities and unknowns alike.
While the offender may feel he/she won't be caught, the FBI and even state authorities have many laws at their disposal, as well as new technology to search out and find those breaking the law.
Under the California Identity Theft Law covered in section 530.5 of the Penal Code, a person charged with identity theft can be convicted if the prosecutor proves all of the following:
- A person willfully obtained personal identifying information of another person;
- The information was obtained without authorization;
- The information was used for any unlawful purpose, including obtaining credit, goods, services, or medical records in the victim's name and without the victim's consent.
