Smokers and Businesses Are Getting Dumped on By Antismokers

The purpose of this lens is to spark a dialogue (or maybe a diatribe) between non-smokers, smokers, and business owners. Big pharma stands to gain a lot from programs to ban smoking and by promoting the idea that smoking is an addiction that requires medication. Meanwhile, business owners, bars and restaurants are already feeling the pinch from smoking bans. They're getting a bad rap and  can use some active support from those of us who believe they have a legitimate bitch.

Have They No Shame?

Anti-smokers have lowered the bar.

The anti-smoking folks have lowered the bar another notch. A 30-second spot run in the NYC area terrorizes a 3-1/2 year- old child to make him cry--so they can make their point.

The child's mother abandons him in a crowded train station and he burst into tears. Not phony tears-real tears of terror.

The message to encourage smokers to quit is: "If this is how your child feels after losing you for a minute, imagine if they lost you for life."

The producers say it was only for about 10 seconds, and then his mom came back and gave him a big cuddle. I don't care how long she left him in that scary situation; for that child it was an eternity and long enough to terrorize him.

Come on do-gooders, play fair and don't abuse little kids to help you get your way.

Nevada company says "Ouch" to smoking ban

Herbst says smoking ban hurts earnings

Herbst Gaming services has 7,200 slot machines in 650 places. These are places where people dine, drink and shop. Company spokesmen say Nevada's tougher new laws outlawing smoking are hurting business. Is it ever! They reported a net loss for the first quarter of this year of $3.9 million! That's a big- time hurt.

And that's not all the damage. Since they share revenues with the non-casino businesses where they place machines, these businesses also get bruised. We don't have figures on the loss to them, but it represents a lot of cash.

Herbst said, compared to a year ago, its slot route revenues were down 17 .8 percent. That's a nasty $16.2 million less than a year ago. We're not talking poor management. The Company says that loss is directly attributed to the smoking ban, approved by voters last November.

It's not nice to fool mother economy. Voters---many of whom voted against the new bans--- will just have to wonder where the money went---money that could have been part of the State's economy.

Wham! Bam! Another Smoking Ban!

Keyport, NJ says you can't light up with kids in your car

An ordinance passed April 24, 2007, to ban smoking in autos with children is, according to Keyport Mayor Robert Bergen, intended as a public policy statement about the need to take care of our kids.

Audrey Silk, founder of NYC's Citizens Lobbying Against Smoker Harassment (CLASH) was quick to respond: "A car is an extension of your personal property. When the government regulates what you can do in your own private property, everybody should be afraid of that."

One observer said, "Do we really need a public policy statement that we should take care of our kids?" Another commented, "Where next? My home? The john? Give me some slack."

Editor's Note: If you think smokers should be cut a little slack, join CLASH. It's free.

NYC Smoker's Group Invites Non-smokers to Join

Citizens Lobbying Against Smoker Harassment (C.L.A.S.H.)

Audrey Silk, founder of N.Y. Citizens Lobbying Against Smoker Harassment, says over-restriction causes lawlessness. In a letter to The Press of Atlantic City, Audrey said, "Adults who choose to smoke---having been kicked out of every single indoor place where they want to socialize and have fun----will revolt. There's only so much normally law-abiding citizens who have been turned into outlaws overnight will take. Adults who smoke have always been the ones willing to compromise---just wanting a place to smoke among their own with the owner's permission." Sounds reasonable to me.

Mission Statement

In their mission statement CLASH charges that a small cabal of prohibitionists and social engineers has launched an effective, systematic campaign to demonize and de-normalize anyone who lights a cigarette.

CLASH's goal is to stop the noise, let the voices of reason be heard, and counter lies with truth. They say their mission is to rescue the constitutional rights of all to:

Free assembly
Equal protection
Equal access to public life

The group says it's not just a fight about smoking. It's about basic values and the way we're going to live. So, please turn on your objectivity button. Get CLASH's side of the issue at: http://www.nycclash.com/main.html

Smoker's and non-smokers are welcome to join the group. Membership is free and they'll keep you posted on the progress of the battle.

Coming Soon to a Bar Near You: "The smoke-easy"

Rap on the door. Put your mouth to the peep hole and whisper, "Joe sent me." You'll be slipped into a cozy room where you can bathe in secondhand smoke, sip your beer, add a few puffs to the haze, and enjoy yourself.

What's more you won't get busted by some undercover meter-maid in a hooker outfit hustling you so she can make a bigger bust than her last parking ticket.

That's what can happen if smoking bans morph into smoking prohibition. Legislation passed and on the books is heading in that direction. And the neighborhood smoke-easy is just the tip of the tempest.

An Open Agenda

The axe I grind is not for me. It's for all smokers labeled as pariahs and for business owners. I want to help hone an edge of tolerance, objectivity, empathy, fairness and reason among the antismoking vigilantes and the sheeple {sic} who follow them.

I am not a smoker. I quit half a century ago. My wife is not a smoker. She quit over a decade ago. But both of us are compassionate for those who try to quit and can't and for those who just don't want to quit.

We are strongly against mandated smoking bans in any non-government owned business.

Entrepreneurship should grant certain rights and privileges. Business owners should have the right to determine whether they operate a non- smoking business, or a business with or without a non- smoking section.

Smokers and non-smokers should have the right to patronize or not patronize any business. We don't believe others should dictate how a business accommodates its customers.

In a free market, choices present niche opportunities for both businesses and consumers.

Secondhand Smoke

Fear of secondhand smoke is scaring the hell out of people. And there's research that justifies some concern. But it's not a cause for panic and draconian measures that trample people's rights.

We humans do a lot of dumb things--- some by choice, some by accident. Do-gooders cannot protect us from ourselves. The resources we pee away on petty pursuits don't need the added cost of smoke cops or rewards to vindictive snitches.

Anyway, if we're going to protect us from our stupid selves, let's prohibit overeating, not exercising, anything that causes stress, poor dietary choices, and a host of other vices.

Where in the hell has objectivity, empathy and reason gone? Simply admitting that there might be another side to the debate is the first step.

Smokers Need the Support of Non-smokers

To protect their rights, smokers need the support of non-smokers. They can't win the crusade against them without help. Non-smokers outnumber them about 2 to l. Smokers need allies with a sense of fairness---non-smokers who want to do the right thing.

Both sides--- the tobacco industry and the antismoking attivists --- have funded and promoted the results of some good science and maybe some junk science, too.

We do not encourage smoking. This is a plea for the militant, inconsiderate smokers to lighten up a bit and behave, and for the antismoking folks to be reasonable. And it's a plea for both sides to study the facts.

Links to both sides of the debate

There is no such thing as complete objectivity, but it's worth a try. It's hard to listen to the views of others that conflict with our own. The links presented here probably won't change anyone's mind. But maybe they'll shed some light on both sides of the issue.

Non-Smokers for Smoker's Rights

It's an idea whose time has come

Even if you're violently opposed to smoking, do you think smokers and business owners are being treated fairly?

My mother has been a smoker for as long as i can remember. Even since I was a baby, from what I've been told, she has almost always has a cigarette in her hand. I am a completely healthy, happy, and free from second-hand smoke damage. In the national anthem, does it not say "home of the free"? Where is our freedom if the government, a democracy mind you, is dictating what goes on behind the doors of our home; doors we've payed for as well as payed taxes on. Since we do pay our taxes (that being the only tie between our home and the government) and are not breaking the law in anyway, whose right is it to take away things that, despite forged evidence, in no way affect others. Even in the defense that the evidence proves to be factual, if the people smoke in their own houses, who is it harming then but the actual smoker?
