Oxfordshire PCT has a duty of care to the residents of Oxfordshire to plan and secure health services and improve the health of the local population.

But did you know that while Oxfordshire PCT attempt to do this that they have created policies that discriminate some of the most venerable Oxfordshire residents?

Oxfordshire is one of the highest tax paying counties in the UK; however we receive one of the lowest budgets for our local health service. Oxfordshire PCT hides behind this fact when they try to wriggle out of arguments when they have no way of defending their own discriminative policies.

This is a DISGRACE! And Oxfordshire PCT should be held fully accountable for the lives that their policies may ruin.

It is true that Oxfordshire gets a smaller health budget then many other counties and YES this is wrong but, let's remember that they don't always spend all of this budget direct on our healthcare. Remember that Oxfordshire PCT is sitting on a forecast surplus of £2 million, money that could go directly into healthcare.

One group of people who gets discriminated against in Oxfordshire are couples that suffer from infertility issues. In 2004 the National Institute of Clinical Excellence (NICE) stated very clearly that couples who were aged 23-39 years that have an indentified cause of infertility or who have been infertile for 3 years should be offered 3 cycles of In Vitro Fertilisation (IVF), funded by the NHS.

Oxfordshire PCT's current policies state that the following criteria needs to be fulfilled to receive funding for IVF treatment in Oxfordshire;

All couples and individuals must meet the following criteria to be eligible for treatment:

  • The woman must be aged between 35 and 38 inclusive, and must be neither overweight nor underweight (Body Mass Index between 19 and 30)

  • Both the man and woman must be non-smokers

Couples and individuals who are not eligible for treatment:

  • If the man and the woman have had a child together (including an adopted child) OR if either of them has had a child in a previous relationship, (including an adopted child), they are not eligible for treatment

  • To fertile women who are in a same sex partnership, or fertile women who are single

  • If the woman has previously had NHS or privately-funded fertility treatment (IVF and ICSI), they are not eligible for treatment.

As you can see, these polices discriminate against infertile couples between the age of 23-34, people that are in a same sex relationship and people who have had children in other relationships.

Let's look at each of these areas carefully.

Discrimination based on Age: 

Discrimination of any sort and for any reason is always wrong; however Oxfordshire PCT's discrimination of couples aged 23-34 is especially cruel and unjustifiable as they are causing women to wait until they are less likely to conceive before they offer funding for treatment.

Oxfordshire PCT argue that they would need much more money to pay for treatment if the age range was widened; however this is a weak argument as if a couple needs IVF they need it. Why would making them wait, save Oxfordshire PCT money? These couples are not asking for more money, they are just asking for the money that they would be entitled to when they were 35. Giving many couples funding while in their 20's would increase their chances of conception by around 200%.

Also, if Oxfordshire couples that were affected by infertility lived in Coventry (just over the Oxfordshire border) or the east of England, they would have access to full funded treatment in line with the guidelines from the National Institute of Clinical Excellence. This means that Oxfordshire residents are all affected by a very unwelcome 'Postcode Lottery'.

Discrimination based on Sexuality: 

Fertile homosexual women are classed as 'sub-fertile'; however there is an extremely strong argument that sub-fertility and infertility in this group of individuals is one of the same.

Homosexuality is not always a choice so why should homosexual women be discriminated in against this way?

Discrimination based on Family Status: 

Think about it. Imagine that you're 23-39 years old and at last meet the man or woman of your dreams! If this was you and either you or your new partner had a fertility problem and either of you have had kids from a previous relationships then you would not meet Oxfordshire PCT's policies for funding, even if the child from the previous relationship is now an adult. That means you have a choice to remain childless or find a new partner. This is a despicable position to be placed in by Oxfordshire PCT.

Educating Ljuba... 

Dr Ljuba Stirzaker, Oxfordshire PCT's Consultant in Public Health Medicine

Dr Ljuba Stirzaker, Oxfordshire PCT's Consultant in Public Health Medicine disagrees that denying treatment to people who don't fit into their rather limiting policies is discrimination.

When asked what it was then, she could not give a straight forward answer.

Well Dr Stirzaker, you will be happy to know that I have written this section just for you. I hope that you like it and that you learn something new from it.

The Oxford English Dictionary clearly defines the word 'discriminate' as follows;

"make an unjust distinction in the treatment of different categories of people, especially on the grounds of race, sex, or age." Source - Oxford English Dictionary

So Dr Stirzaker, as you can see, denying someone treatment based on age is definitely discrimination.

At meeting on Wednesday (13th May) this week I (Richard MacKenzie) called for Andrea Young's (Chief Exec Oxfordshire PCT) resignation over the IVF funding scandal here in Oxfordshire.

Sitting Protest at Oxfordshire PCT 

She left laughing... Really shows you the depth of the woman...

On Thursday the 13th of May 2009, four of or our campaigners entered the PCT to demand justice for couples suffering from infertility issues in Oxfordshire. After around 20 minutes we were formally requested to leave by Ruth Atkins (Communications Manager) of Oxfordshire PCT.

We half expected to be kicked out, but Ms Atkins the Oxfordshire PCT's 'spin doctor' seemed very shy to have this recorded in a photo by an Oxford Mail photographer...

We were informed that Andrea Young was in the building (this was confirmed by our person on the inside) and was in a meeting. We stayed put until Andrea Young left and then had an exchange that ended with her laughing as she was driven away by Alan Webb who is Oxfordshire PCT's Director of Commissioning.

Yet again we were shunned...

It is a disgrace that this type of discrimination of couples in the UK is thought to be acceptable by certain PCT health officials.

Here in Oxfordshire we are fighting the PCT to follow full NICE guidelines and so far our campaign has been going well.

This is a fight that we will win.

    Yes! I've appealed written to my MP etc etc it was not IVF but something that according to NICE I met all guidelines I should receive treatment and Oxfordshire PCT declined funding as they had set guidelines above that of NICE, and I could only be treated in exceptional circumstances-more or less dying!!! Someone else where in UK would have got this based on NICE guideline alone, but not Oxford! Post Code Lottery at it's finest!!!!!! Soooooooooooo angry

    Hello. I am 24 and married. I came off my pill 2 years ago to start trying for a baby and i have recently been diagnosed with Premature Ovarian Failure - aka early menopause.
    This news was devastating enough but then to make it worse we were told we had to pay £6000 to have a baby! So our heartache for a baby will have to carry on for years while we save!
    The JR did appeal but they came back and said no because i was too young! It is ridiculous! even my GP said on Friday that she will now appeal because it is a joke, her words were why not fund someone of your age when the success rate is so much higer than someone in their late 30s. They say the nhs dont have enough money but they choose to use it where its less successful.
    I a praying that one day we will get a miracle!
