When can someone repossess my car?

If you signed an agreement making your property collateral for a loan, then a creditor can repossess this property if you default on the loan. This process usually involves automobiles. Even if you are one day late with your payment a creditor can repossess your car. They do not have to provide you with a grace period or extra time to make your payment

Can someone come onto my property to repossess my car?

A creditor may repossess an automobile at any time if it can be done so peacefully. They do not have to notify you before they repossess it. A creditor cannot trick you into bringing your car to a certain location or in for repairs in order to repossess your car. A creditor cannot use any force or threats of violence to repossess an automobile. A creditor does not have to take you to court or sue you before repossessing an automobile.

What if I had personal property in the car when it was repossessed?

You have the right to get back any property you had in the car at the time it was repossessed. You should go to the creditor immediately to get your things back. If you cannot pick up your property right away, write the creditor a letter listing the items you need to retrieve and then make arrangements to pick them up.

What happens after my car is repossessed?

Once your car is repossessed, the creditor must send you a notice of your right to redeem the car. Your right to redeem just means you have the right to get the car back. Unfortunately, most of the time you will have to pay the entire balance of the loan, not just the amount you are behind in order to get the car back. Bankruptcy will not allow you to get the car back.

If you do not redeem your car or get it back, the creditor will normally sell it. If they get less money for the car than what you owed on the car, you still owe the creditor the difference. The creditor will usually attempt to collect the difference from you and ultimately sue you for payment if it remains unpaid.

    when a car is trying to be repoed .... can they call law enforcement to make you turn the vehicle over to them

    Do to today's economy, I had my vehicle taken yesterday. Reading the words here are a great way to inform people about this topic. Living through it though, is a horrible thing.
