Although the most common view of divorce involves constantly fighting, if approached in the proper way, divorce can actually be a more friendly interaction. There are four forms of the negation approach:
1. Cooperative Divorce Law
2. Divorce Mediation
3. Collaborative Divorce Law
4. Knowing what to say to get your spouse to accept your settlement offer.
Common Myths
There are several myths about divorce that many people believe, so what is fact and what is not?One of the most common questions is "Can my spouse prevent us from getting a divorce?" The answer is no. Although your spouse may not want to agree to a divorce, you can proceed with a divorce as long as you can show that they have committed on of Illinois's eleven grounds for divorce.
Another common myth is that the court requires marriage counseling. Although the court would love to keep each family unit intact, they cannot make you reconsider your decision to seek a divorce.
"Children are able to choose who they want to live with" is another widely believed myth; however the court does not consider the wishes of children until they have reached the age of 14. Even then, they are not required to rule according to the wishes of the child. A court must consider several criteria before deciding the custody of children.
"Upon reaching a settlement we do not have to appear in court." Although many would like for this to be true, it simply is not. Even if a settlement is reached, the party that brought the action must appear in court and provide facts that are required by the Illinois divorce act.
Does the money that is paid for child support include daycare, activity expenses, or extracurricular expenses? The answer is no. These things are not figured into child support payments, and would be extra contributions.
