Appeals Court Orders New Sentence Hearing for Wal-Mart Exec Who Got Home Detention for Fraud
BENTONVILLE, Ark. (AP) -- A former Wal-Mart executive who was sentenced to home detention in a fraud case got off too light and must be sentenced again, an appeals court ruled Tuesday.
Prosecutors had argued U.S. District Judge Robert T. Dawson failed to consider the gravity of Tom Coughlin's offense while giving him credit as a pillar of the community.
The 8th U.S. Circuit Court of Appeals agreed, saying the sentence of 27 months of home detention and 33 months of additional probation was too lenient.
"Perhaps Coughlin's family ties and station in the community, as well as his lofty corporate position of trust and power, exacerbate the nature of his crimes, especially for Coughlin's victims: Wal-Mart, and more generally, American businesses," the court wrote in a split decision.

Consumer Confidence Index Drops in August Amid Financial Market Volatility, Housing Problems
NEW YORK (AP) -- Consumer confidence weakened in August as volatile financial markets and housing problems took a toll, a private research group said Tuesday.
The New York-based Conference Board said that its Consumer Confidence Index, declined to 105.0, from a revised reading of 111.9 in July, which was a six-year high.
Although the index was down, it was slightly stronger than the 104.5 that Wall Street analysts expected.
"A softening in business conditions and labor market conditions has curbed consumers' confidence this month," said Lynn Franco, director of The Conference Board Consumer Research Center. "In addition, the volatility in financial markets and continued subprime housing woes may have played a role in dampening consumers' spirits."

WASHINGTON (AP) -- The Federal Reserve and other banking regulators issued special guidance Tuesday urging loan service companies to work with borrowers in danger of defaulting on their home mortgages.
The new guidelines are not mandatory, but the regulators expressed the hope that companies that collect payments on mortgages would heed the advice.
Sheila Bair, chairman of the Federal Deposit Insurance Corp., said that mortgage collectors have the authority under existing accounting and tax rules to help deserving borrowers.
