The Legalities of Copying DVD's

DVD Copy Software - Is DVD Copy Software Legal

DVD Copy Software - Is DVD Copy Software Legal
By Richard Seng

Is copying DVDs and CDs legal? Are you allowed to copy your own DVDs? Are you allowed to copy CDs and DVDs that are copy protected. These are excellent questions and there is a debate on this issue between the public and the music recording manufacturing.

The recording industry states that backing up copies of your DVDs for any reason is not legal since to do so is a copyright violation, but the public buyers of DVDs are in favor of the Fair Use Act and the Audio Home Recording Act of 1992.

The Act of 1992 Home Audio Recording says that the recording industry cannot file a lawsuite against the typical user of DVD software for backing up home and personal copies of their movies and music.

These laws are subject to explanation, but in a simple review - you can legally backup a copy of your DVD or CD for individual personal copying if you were the person that purchased the DVD or CD (and still have ownership) of the original disc.

The Digital Millennium Copyright Act (DMCA) says that it is not legal to crack or break the CSS copy- defense system developed for many of the store bought DVD movies.

What do these laws and interpretations mean? Most fair-use supporters say that the guidelines directly disagree with U.S. copyright law, but the Digital Millennium Copyright Act (DMCA) seems to specify that you can not make a legal backup of a store bought DVD, even for your own personal and individual use, and you definitely can not furnish a backup DVD copy to anyone or view a backup DVD files on your PC.
