Cash Gifting: Facts and Myths!

This is the reason why so many people, including myself, are so skeptical to deal with any of the many cash gifting programs available today.

When I first read about cash gifting I told myself that it was just too good to be true and it could be nothing but a Get Rich Quick Scam or Illegal Pyramid.

I was however very curious because I found many people defending the concept. I felt trapped and could not avoid thinking "What if this is true?" What if I really could have a cash day every day? So I decided to investigate seriously the whole thing.

Everybody agree that it is legal giving a gift of money to any person or entity. The law states it very clear. See Publication 950 del IRS.

However, many people still affirm that cash gifting programs are illegal. The main claim against cash gifting legitimacy, is that its participants really DO NOT give a gift of money since they actually expect to make money from that "gift".

Critics say these programs use tricks to make an illegal activity look legal.

So, if you "give" money to somebody and in exchange "get" a right to receive money yourself then that was not a real gift. You gave your money expecting something in return. That's what they say.

Well, I can't help but agreeing that cash gifting members give a gift expecting somehow to receive what they give multiply. They belief that whatever you give out, good or bad, you will get back.

When you give a gift you expect to bless someone's life and , why not, be blessed as well.

Now, I have a question for cash gifting detractors. If expecting to receive something in return, no from the actual gift receiver but from the belief system, make cash gifting programs illegal, how can they explain the legality in the case of the Tax Deductible Contributions?

The publication 526 del IRS explains how to claim a tax deduction from charitable and other contributions.

Following the criteria of cash gifting detractors we would have to conclude that people who donate to "qualified institutions" could just go to the street and give the money directly to the poor and homeless. There will be no tax benefits and the "gift will be a real gift". Right?

But in our country, it is absolutely legal and moral to "expect to receive" tax benefits from those donations or gifts.

When you give a cash gift to somebody in a cash gifting program you do not expect anything back from the person that receive your gift. You expect however to bless him/her life and be blessed yourself from your free participation in the gifting system.

I am not a lawyer, but I don't see why expecting to receive a benefit would be illegal in one case and not in the other.

In my research about cash gifting programs I did not find anything that explicitly state they are illegal. On the contrary, I found that some of those programs have been running for 6, 7 and up to 9 years. If they are actually illegal, why aren't they been shut down?

Draw your own conclusions.

A pyramid scheme is an illegal money making venture. A few participants at the top of the pyramid recruit new participants for the bottom.

The new recruits pay money to enter the scheme and then have to recruit new participants that have to do the same. As the pyramid expands it requires recruiting more and more members at an exponential rate.

But, there are only a limited number of people in the world. It is mathematically impossible for pyramid schemes to grow indefinitely.

As a result ,the pyramid inevitably collapse. Many people lost money and only those on the very top get rich. A pyramid scheme is absolutely illegal.

A Scam is a scheme for making money by dishonest means. It is a ploy by a shyster to raise money.

If a Cash Gifting program meet any of these definitions you can say it is an illegal pyramid or a scam.

Most programs I found have not a pyramidal structure. Even when you need to recruit new members the new members have the same opportunity than the old ones.

In one of those programs once you receive your gifts you have to give gifts again to continue as a participant in the system. So old participants actually help new members to receive their gifts. An exponential growth is not required and everybody can benefit from the system.

Many programs also have a one tier structure known as 1up. Cash gifting programs explain clearly how their systems work, and contrary to most money making opportunities, all details are explained upfront.

Before joining the programs you have to understand that you will be giving a gift without expecting anything. There is no guarantee that you will receive any money.

My opinion is that there could be some cash gifting programs that are actually illegal pyramids or scam, but that doesn't mean that all programs are.

Indeed, I think most cash gifting programs has nothing to do with the definitions of illegal pyramid or scam above.
