What Are The Roles With The FCC and FDA in Regards to Cell Phones?
Under current law, the FDA does not review the radiation emissions of consumer bought products including Cell Phones and other similar wireless devices before they are offered to the consumer, as it does with new pharmaceutical drugs or medical devices. However though, the FDA does have the authority to take action if any cell phone has shown to emit radiofrequency energy (RF) at a level that is dangerous to the consumer. In such a case, the FDA could require the cell phone manufacturer(s) to notify consumers of the health hazard and to repair, replace, or recall the phones that create this threat.
The FDA belongs to the Radio Frequency Interagency Work Group. The federal agencies in the Radio Frequency Interagency Work Group have responsibility for different aspects of RF safety and work together to ensure coordinated efforts through the federal level. The other agencies in the Radio Frequency Interagency Work Group are:
National Telecommunications and Information Administration
National Institute for Occupational Safety and Health
Environmental Protection Agency
Federal Communications Commission
Occupational Safety and Health Administration
The FDA shares responsibilities for cell phone regulations with the Federal Communications Commission (FCC). The FCC certifies wireless devices, and all wireless phones that are sold within the USA. Mobile Phone manufacturers must comply with FCC guidelines on RF exposure. The FCC uses the FDA and other health agencies for instruction on health and safety for cell phones.
The FCC also regulates cell phone tower stations. These tower stations operate at a much higher power and frequency than cell phones. The RF exposure the public experience from tower stations are typically much lower than from Cell Phones because base station antennas are mounted on towers higher above giving less exposure to those on the ground. Both cell phone manufacturers and base tower stations are required to comply with the FCC RF exposure guidelines.
International Cell Phone Safety
For some time, Japan, Korea, the European Union, Australia, China, the World Health Organization, and the USA have met to discuss health concerns and findings for wireless communications. The purpose of these meetings have been to discuss scientific issues in regards to RF exposure from mobile wireless communications technology from an international perspective. The International Telecommunication Union estimated that mobile cellular subscriptions worldwide would reach approximately 4.6 billion by the end of 2009.
