What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is often erroneously called a "liquidation bankruptcy." However, only about 0.5% of Chapter 7 filings result in the significant sale of property. An experienced attorney may be able to help you secure exemptions for most or all of your property, including homes, vehicles, and other items. It is a bankruptcy option available to many individuals and is a useful way to minimize debts and regain control of your finances. It is unique from other types of bankruptcy and may allow for certain properties to be retained.

Should I file for Chapter 7 or Chapter 13 bankruptcy?
Due to recent law changes, it is more difficult to file for Chapter 7 bankruptcy. Although, if you are really in a situation where you can not repay the debt you have acquired, it may be your best option. The government prefers for individuals to file for Chapter 13 bankruptcy so that they can pay out some or all of their debt over and extended period of time.

Frequently Asked Questions (FAQs)
Q: How Can I Rebuild My Credit After Bankruptcy?A: Their are a number of steps a person can take may improve his or her credit after bankruptcy. A few of them include discharge results in an improved debt-to-income ratio, use credit cards wisely, cosign loans, and seek help from a unscrupulous credit-repair service.
Q: What is a workout?
A: A workout is an agreement between the debtor and his or her creditors for payment of the debts between them that is negotiated without all the bells and whistles, and perhaps the stigma, of the bankruptcy process.
Q: What are the effects of a salary increase on a wage-earner plan under chapter 13?
A: It seems only fair that if the payment plan does not project paying debts in full and more income than was planned for is actually realized that the extra money should go to the creditors, and not be retained by the debtor. In fact, courts often subscribe to this view that the debtor should not be unjustly enriched to the detriment of creditors. However, the debtor may be allowed to retain the increase in income unless the increase is significant and there are no offsetting increases in expenses.
