Stand Up to Abusive Collection Agencies

Collection agency harassment runs rampant.  The FTC reported that in 2005 that over 66,000 incidents of collection agency abuse were filed in their 2006 report to congress. [pdf]

Collection agencies must abide by the Fair Debt Collection Practices Act which was enacted in 1977 to prevent collection agency abuse.  Many forms of intimidation by a collection agency are considered harassment and you do not have to stand for it.

While the Fair Debt Collection Practices Act does provide consumers with the ability to sue a collection agency it is beyond the scope of this article.  If you take the time to report collection agency harassment it may prevent another consumer from experiencing what happened to you and may even cause the FTC to step in and take action against them.

While it may be impossible to describe every type of abuse I have highlighted some of the easy ones to identify. If a collection agency has done any of these things to you make sure you report them.
  1. Treated you in a Disrespectful way.
  2. Tried to make you feel Undignified
  3. Used unfair tactics in an attempt to trick you
  4. Made Untrue Statements

How to report them online 

You can report most collection agency harassment right online. It is best if you have the dates and times and know exactly what they said or did.

To report them for harassment it does not matter if they broke the law. All that matters is that you were uncomfortable with how they treated you.
Federal Trade Commission - Online Complaint Form
The FTC receives thousands of complaints a day about abusive collection agencies. While they may not investigate you individual complaint if enough people complain about a specific collection agency they will step in.

They have closed down many abusive collection agencies and levy huge fines against several each year.
State Attorney General
Report them to your State's Attorney General and Theris!
The Better Business Bureau
Enough Said
The ACA
This is a collection Agency Trade Association. Even if they are not a member take the time to report them.
Document their abuse
That is a simple self help way to document their abuse. It may help you recover damages against a collection agency if you decide to take them to court.

    Mitchell D. Blum (and assoicates) are not lawyers and this is not a law firm, although Mitch is a lawyer, he runs a business that specializes in BUYING, for pennies on the dollar, debt from Hospitals and Health Care providers and then employing a bunch of 20-somthing low lifes to essentially call and use the internet to find and harass the debtors. Regardless of the circumstances, you'll find two things: (1) you pay THEM, since they bought the debt, and (2) they will bargain with you for a lesser amount, as this is their profit margin.

    They have no legal teeth, they can report you to the collection agency and little beyond that ... oh yeah, and call you relentlessly with idle threats and banter of that sort. They are running a business.

    If you really do owe someone some money, you can settle with them, ignore them and re-contant the original debt holder and work something out.

    This is a "for profit" group who specialize in intimidation. Don't pay them! Hang Up!

    Hi,
    I am dealing with a collection agency that will not even look at the documents I have. It's only 60.00 but I'm way past the point of 60.00, it's a matter of principle now. I have a document that clearly shows that that I should have been credited for a stupid case of fish and they refuse to look at it. I'm not going to pay 60.00 I don't owe. Where do you turn? this thing is on my credit report and is dragging down my credit score, but I refuse to be intimidated into paying money I don't owe. HELP!

    I think this is a great post and i plan to add it to my lense roll. the reason why is while i delt with a debt settlement company and before i joined i was harrassed and illegally. the sad part is most people dont know its illegal and what to do about it. thanks for the great post and it is truly a help to those in need of information on what to do.

    This is to inform the American people about JPMorgan Chase collection pratices they will harrass people from 8am in the morning until 9pm at nite everyday of the week nonstop... the elderly, the disable, and Senior Citzens for bad debts that they brought from companies that have went out of business and This is one of the GREEDY BANK the American people bailout . So does that mean they too owe people but got bailout....HELLO
