Being in Collections is Never Fun

 

Being harassed by a collection agency is never fun and how you deal with that harassment may mean the difference in sanity and protection of your rights offered by laws that govern collection agencies.

Many times when a collection agency contacts you or others by phone they violate collection agency laws.

Some Phone Tactics that Collection Agencies Use 

There are many things that a collection agency will do to attempt to intimidate you over the phone. Most of these activities are illegal and if you can document their antics a collection agency may owe you money.

It is illegal for a collection agency to:
  • Imply that the failure to pay a debt will result in imprisonment, arrest or garnishment of wages.
  • To call you at work when they know it is against your company rules to receive calls of this nature at work.
  • To talk with third parties such as children, neighbors or employers except to acquire your location information.
  • Cause the telephone to ring, or engage a person in telephone conversations, repeatedly or continuously, with the intent to annoy, abuse, or harass a consumer;
  • Threaten to take action such as filing a lawsuit when they did not intend to do so
  • Call consumers at times or places that they knew or should have known were inconvenient
  • Fail to notify consumers of their right to dispute and obtain verification of their debts, and to obtain the name of the original creditor.
  • Continue to try to collect debts after consumers disputed them in writing, and before verifying the debts.
  • Use obscene or profane language.

The talk off is designed to scare the consumer or is used on answering machines to get a call back from the consumer.

They usually sound something like this:
  • Hello, I'm calling from XYZ Law Office - We are in the process of filing an affidavit for JIM BOB WILLIAMS to appear in DALLAS County court. We need to confirm an address for delivery of a summons and or discuss any out of court alternatives. Please have JIM BOB contact me at XXX-XXX-XXXX within the next 48 hours to put a stay of action on their case.


  • Unless they are planning on filing suit intermediately this is highly illegal.

Use their violations of the Law as a Negotiating Tool 

Having proof of them breaking the law is a powerful negotiating tool when dealing with a collection agency. The best way to have proof is record them in the act.
