Driving under the influence of alcohol, drunk driving, or drink-driving, is the act of operating a motor vehicle (and sometimes a bicycle or similar human-powered vehicle) after having consumed alcohol (ethanol) or other drugs, to the degree that mental and motor skills are impaired. In addition to driving under the influence of alcohol and driving under the influence of other drugs, a third "DUI" offense consists of driving under the combined influence of alcohol and other drugs. The drugs causing or contributing to the impairment need not be illegal, but can consist of lawfully prescribed or over-the-counter medication. Anti-drunk-driving advertising campaigns have aimed to raise awareness of the legal situation and the dangers of driving while intoxicated. Drunk-driving is responsible for a large number of deaths, injuries, damage and accidents every year.
NHTSA Field Sobriety Tests
During the late 1960s and early 1970s more than 50,000 people lost their lives each year on our nation's public roads; more than half of the fatalities involved an alcohol-impaired driver. Traffic safety has improved considerably since that time: the annual death toll has declined to about 40,000, even though the numbers of drivers, vehicles, and miles driven all have greatly increased. When miles traveled are considered, the likelihood of being killed in traffic in 1966 was more than three times what it is today.

Research sponsored by the National Highway Traffic Safety Administration (NHTSA) has contributed to the improved condition, in part, by providing law enforcement officers with useful and scientifically valid information and training materials to assist in the enforcement of drinking and driving laws. Beginning in 1975, NHTSA sponsored research that led to the development of a Driving While Impaired (DWI)1 detection guide that listed 20 driving cues and the probabilities that a driver exhibiting a cue would have a BAC of at least 0.10 percent (Harris et al., 1980; Harris, 1980). A similar study was conducted more recently that identified 24 driving cues that are predictive of DWI at the 0.08 level (Stuster, 1997); the latter study also identified ten post-stop cues with probabilities of DWI of at least 90 percent. NHTSA previously sponsored research that led to the development of a motorcycle DWI detection guide and training program (Stuster, 1993). NHTSA's DWI training materials, based on the results of these studies, have exposed the current generation of law enforcement officers in the U.S. to information critical to DWI enforcement by providing a systematic, scientifically valid, and defensible approach to on-the-road DWI detection.

What happens after a DUI/DWAI arrest in Colorado?


  1. Motor Vehicle Hearing:

    To preserve your right to drive in
    Colorado, you must request a hearing within 7 days after your license
    has been taken from you by an officer or within the time set by Motor
    Vehicle in a revocation letter. A hearing must be initially scheduled within
    60 days.

    If you
    had a valid license when stopped, you are qualified for a temporary
    license to drive until the hearing. You will be mailed a notice of the hearing
    about three weeks after your request. You can plan on at least 45 days
    of driving.

    If you lose at the hearing, you can not drive after the
    hearing. It is our opinion you should requests the officer's presence
    at the hearing. Crucial defenses can be developed at the hearing. It is
    best to make a hearing request at the main Colorado Motor
    Vehicle Office, 1881 Pierce Street in Lakewood.

  2. Arraignment:

    This is the date on your ticket, about 30 to 60 days after
    your arrest. If you have an
    attorney and are not on bond, you do not have to appear. It is
    primarily for advisement of rights. If you have an attorney, he will
    advise you.



  3. Pre-trial Conference:

    Your attorney will discuss your case with the
    District Attorney and negotiate the best possible plea bargain. It will
    happen about 6 weeks after arraignment. This
    is usually after the Motor Vehicle Hearing. The date is set by the
    Court and your attorney on his calendar.



  4. Suppression Hearing:

    The Court may suppress some or all of the
    evidence against you if your constitutional rights have been violated.
    Your attorney will file motions to suppress. It occcurs anywhere 6 weeks to 3 months
    after the pre-trial conference.



  5. Trial:

    Almost always a trial to a jury of six. Trial must be held
    within six months after your plea.



  6. Sentencing:

    The Court imposes a sentence after a conviction at
    trial or after a plea bargain is accepted and a plea entered. Sentences
    may include jail time, in home detention, public service, alcohol
    classes and fines.
