Compensation Claims - How is Compensation Calculated?

To those who've not had much experience of compensation claims, compensation can seem very confusing.

If a person wins their compensation claim they could be offered thousands of pounds, yet someone else who may have suffered a similar accident might only be awarded a few hundred. How do the courts make sense of it all?

To understand compensation you first need to understand why you are being awarded compensation in the first place. Here are the main reasons people are awarded accident compensation.

Loss of Earnings

In most cases this is the easiest to quantify. If you were forced to miss work and lose income as a result of an accident, this will be calculated and added to your compensation package. If you are an employee this is easy to quantify. If you work for yourself it's a little more difficult. In this situation you may be required to show some evidence of your business accounts.

Medical Costs

If your accident resulted in you needing immediate or ongoing medical care, this will form a large part of your compensation package.

Small, Out of Pocket Costs

These can include anything from petrol costs to parking charges. Any costs that you have incurred as a result of making your claim for compensation will be taken into account in your final compensation package.

Injuries

This is the most confusing and unquantifiable element of any claim for compensation. How can you put a price on pain and suffering?
Believe it or not there are guidelines which the courts follow when it comes to calculating compensation. The factors which influence it are the severity of the injuries, the lasting symptoms, visible and lasting scars and the pain and suffering that the injuries initially caused.

There are variable factors relating to almost every conceivable injury. To find out more, it would be worth researching your specific injuries online or asking your solicitor to give you an idea of the compensation they expect you to receive.

Though compensation claims may seem like a 'dark art' to most of us, there is logic behind each compensation package. To stand the best chance of getting what you are entitled to, and to have the details properly explained to you, you should always try to use solicitors who specialise in personal injury compensation claims.
