Edgehill Village in San Bernardino - Oligarchy Overlords cause Ordinary Owners to Suffer.
If I had ever spent even 1 week just to see how awful life can be to live in a condominium, It is possible that I may not have bought my place. But in particular my Condominium here in San Bernardino, CA. It is called the Edgehill Village, and there are plenty of good things that I could talk about, but that is not why I made this lense. I made this lense to cleanse any ill feelings I harbour for some entity, or person(s) behind all of this real estate business who I do not know, and may never know. I do know that she/it exists here, and they/it have been a thorn in my pleasant living for 8 years now. I will discuss three things that have occured to me during my residency here at Edgehill Village in San Bernardino, California. I will try to keep as unbiased as I can and then you can decide whether or not the things which have be-fallen me are just or unjust, due or undue etc. I will leave space wide open for you to leave your comments so please freely comment as you wish.
1st item up for miserable existence was the time that I was playing my piano keyboard as I often do, at around 3 P.M. in the afternoon. I wasn't playing loud at all but was fined $50 for playing Mozart. I am a skilled pianist and was playing purely for my own enjoyment. The sliding glass door may have been opened, but my keyboard amp was only turned up to 3. In my own opinion Mozart at a volume of a mere 3, at 3:00 in the afternoon doesn't constitute a nuisance. It's quite enjoyable actually, and soothing amongst other things. However, an oligarchy style tyranny of unjust person(s) obviously had a different opinion, nonetheless I appealed and was spared the fine.
2nd item up for miserable existence was the morning I was late for work and went to go find my car only to find that it wasn't there. I called the police believing that surely it must have been stolen, so I filed a police report only to find out two days later that the housing associations in-house tow company had towed my car away for being 2 inches in a red zone. At the Edgehill Village, parking is really scarce. So scarce that when I have groceries--- well that is another horror in its own right, but it is so scarce that you as owners of a condominium, we pay $99 to have a parking permit that allows all owners the right to park one(1) vehicle. There were residents in here that owned 6 cars, oh boy! Well I finally figured out that it was the "evil" Titan Towing Co. that now doesn't exist but in the shadows of thoughts and dollars. Who had stealthily come at night and turn off their lights so as not to be seen by residents, although they say it is so that they don't disturb the residents, and lo and behold my car was being held ransom at their headquarters downtown. But wait, the story gets better because I couldn't get the car out of their clutches just then because the weekend has just set in, so was told I would have to come back on Monday to get my means of trasportation (my livelihood) out. To the tune of around $480 which I am sure is chump change to a company who must make $70,000 a day from towing away cars that would otherwise not be in anybody's way. Scam or lawful conduct?. Money is the root of all evil. And tow truck companies make a lot of easy money this way. I mean they would tow away cars for any reason without letting the owner nor the police know about their doings, all in the stealth of night and in what seemed a sort of liason wreaking of nepotism between an HOA and perhaps a tow truck or two.
3rd item up for miserable existence at Edgehill Village is the art of fining resident/owners for leaving or supposedly leaving their garage doors open. I must share my garage with another person at the condo's. They are situated very far from where I actually enter my house, and I don't ever remember leaving my garage door open. Never! I always double and triple check. I wonder however if the person that I share my garage with may have accidentally left it open. I also wonder if they were ever served with a notice to pay for the fine again to the tune of $50. I wonder if they were ever charged as I have now had to pay to this scam and the name on the paper was M****** F*****. This person or whoever she may be does make my life more miserable and I have no thanks to give to a woman who scams takes my money for no good reason. I have not the means for the usurpial fees and credits werewith this oligarchy whims their own rules whenever its convenient? If I had tried before I buyed. Even just slept overnight I probably would have seen some of the other side of life in a condo.

They towed me for being in visitor parking the ONE time I forgot to move it because we had a family emergency. They charged me over three hundred dollars to get it out.
Things are far worse now though. The new board sent out a newsletter in the beginning of their administration, and we thought maybe things would start to get better. Instead we still pay $245 a month and meanwhile the security guard is gone, the gate is tied open, and the pool is closed. Yes, the security guards were completely ineffective,but at least there was someone there to call the police when there's trouble. And yes, the drug dealers may have had the gate code, but tying the gate open for the last year, with no security guard, doesn't make me any safer.
We are furious. And we are moving.

Enforcement of private contracts, like homeowners association governing documents is more pleasant and cost-effective that having police crawling around a property. EDGEHILL is approaching a police no-go zone anyway. Here's why vehicles are towed from private gated communities, which are required by law to be posted that unauthorized vehicles will be towed away:

I have had 6 of my friends car towed away. Within 10 minutes it was gone. They had their lights of and were very quiet. They come in in stealth and steal our cars. They say that we are not abiding by HOA rules. I say you and all those who protect this evilness can go to hell. This is my home, this is where I dwell and sleep at night. This is where I take my groceries in at. This is my home you sob's. I shouldn't have to ask my friends who have come over for just 5 minutes to visit that I am constantly worrying about whether their cars are still there. If we are not diligent they take our cars, and also they themselves buy the cars that they towed because we can't afford the weekend fee or the go-jack fee its too much money. You hoodlums!.

3 times, I have been there 10 years now and the first time was because of expired tags (that just expired and i had not gotten the new ones in yet) no ticket, no notice, just a tow ($$$), 2nd was during the time we did not have a tow contract and i parked my car (yes w/o a tag as that was stolen and i was pending receiving my replacement) in the resident parking. I had planned to remove it by 6pm because that is when the standard tow truck drives through and missed my 6pm deadline by 1/2 hr. 3rd time i parked in the visitor parking (a week after the 2nd tow) and accidentally fell asleep. At 3am when i jumped out of bed yup u guessed it my car was gone! Not that we have parking issues much anymore because that night there were 5 open spaces in the parking lot and plenty of room on the street i assure you i was not causing the space of another driver. Bad Excallibre and Haven for allowing these contracted Tow companies to just come in and take our cars when they haven't even been called to do so!

- The newly formed nepotistic older brother of the evil Titan towing is among us. Predatory towing under the name of code 4. What I want to know is who is making the money and getting the new cars? Of course code 4 employees. Benefitting on purchasing cars that have been towed away in secret, I know they got all my tools that I left in my truck that they towed and couldnt afford to get out. What kind of house do tow truck driver's bosses live in? Better yet do they buy the cars that are predatorily and consistently taken from urban condo dwellers? Code 4 towing - If you are involved in a scam you will pay one day...I promise. Too many innocent harmless tenents and owners are being affected by this unneccesary evil that the towing company and the housing association majagement bring to its citizens? I can't have a friend over without fear of losing their car? I am constantly asking everyone if they are in the green zone to park, this is ridiculous. I shouldn't fear my own home@!

- Monthly association dues should be going down; I'm proposing a decrease from $245 to $229 in November and I would not expect them to go back up unless the usual run of ignorant, apathetic board members are once again elected who know nothing of maintenance, repair, and property improvement and won't watch management. EDGEHILL should have adequate investment income to make monthly assessments unnecessary after 30 years and there are several reasons for that. Some special assessments and aggressive management are going to be necessary, including liens and foreclosures on completely non-performing "owners." The greatest danger is getting rid of board members who are productive and capable because dishonest vendors and rental agents (Mark in virtual drag as "Diane Church") want them out of the way. Some tenants act like three-year-olds when something is temporarily taken-away, like a swimming pool where there are problems, and vote-in incompetents.

- Don't know who indicated that I was a "roommate," as I've only posted once before to this blog: Likely Jolstead.
Jolstead is wasting his time as case law trumps governing documents and such pet rules wouldn't fly. He has not asked the board formally to make a new rule about dogs but has asked that the Declaration, sometimes known as the CC&Rs be amended. The by-laws don't address such things.
What is interesting is that he is involved with six other homeowners and a former "handyman" who extracted $120 thousand a year from the HOA in trying to overthrow the existing board. They use the former treasurer's post office box; the HOA still pays $7.1 thousand per month on a loan approved by that treasurer for $225 thousand worth of "termite tenting." Jolstead is worried the board is going to enforce the CC&Rs that would prevent him from much of the illegality in which he is involved at EDGEHILL.
