Divorce without a lawyer?

Alot of people have asked the question if this is possible......

It's called an uncontested divorce. If neither husband or wife contests the divorce, it should go through and be legal with the right paperwork. You fill this paperwork out yourself, and it may be confusing, but it's relatively inexpensive....maybe around $300.00 or so, a rather small fee compared to possible attorney fees. You need to make sure you have all your i's dotted and t's crossed however. You don't to find out later that you missed something. This is where the lawyer comes in most handy. 

 

With any 'package' (by mail or otherwise) you should get all the proper documents, directions on how to fill them out, and a guide of what to do with them once completed. Your children, income, assets and other factors should all be included, and the form should be customized for your state.

Basically the idea is that it's best to work out the hot issues between yourselves, and even with a 3rd pary if you need the help. You don't want to let divorce attorneys have input over how your children will be raised and by whom, who the house goes to and what you will do with your property that you own together. Many couples can work these issues out themselves saving them alot of hassle, not to mention a boatload of money. And also you definately want to keep your children away from the parental fights or custody battle. Divorce can be very traumatizing to them and they should remain top priority no matter what the differences.

If you can work out the issues of children, finances and home/property, all that needs to be done then is to write to the court and ask them to grant you the divorce. Quite possibly you won't even have to go down to the court house itself. Many states now make it possible for people to go through the whole process without an attorney.

As long as you and your spouse think you can do it on your own even though you both are at odds, there are many resources available.
