Thanks for sharing the advice. I am just applying for probate now as an executor so it is timely to read your information. Getting all the required info together is more difficult than some believe even for a simple estate! Documents in the UK are relatively simple for a small estate once you have the information.

Thanks for so clearly detailing what all is involved as an executor. Good to be informed beforehand so steps aren't missed later. ~~Blessed~~

been there and done that! There's a lot more to it than many people realize. Great job.

My mom has put me in her will as her to Executor ... having never executed a will before, I have been feeling a bit overwhelmed about what it all means. It's difficult to think about these legal actions whilst one is grieving, you know? It certainly helps to have everything spelled out.

Great info for someone in the position of being an executor. I'd love to see a lens on the rights of the family in regards to the executor, who can might show bias and not handle things properly. THUMBS UP and ANGEL BLESSED lens.

I found this lens very informative, and I may refer back here, in the future, when I will be tasked with performing executor duties. Thanks.

My friend who had very few assets named me Executrix (female version at the time). It was sweet cause he'd call me Trixie. But he did pass away. I consulted with a probate attorney and together, we did just fine. But I did need a little help and it wasn't too expensive.

I really respect those people who are left with the task of being the executor. Recently, my brother had to take on that task for my aunt. Most people don't understand what the position is and consequently, not only does the executor bear the burden of taking care of the estate but has to deal with negative innuendos of those who do not understand fully and who do not care to understand. Thank you for bringing forth much needed information. Hopefully, more people will understand what's involved.

Good lens but worth noting it is mainly geared towards USA legal system.
  • MiaBellezza Oct 7, 2011 @ 9:04 am | delete
Actually, it is geared to the Canadian legal system with information included for the American legal system. This is just a guideline. It is up to the Executor to apprise himself of all relevant information and procedures pertaining to conducting his Executor duties properly. Consulting a lawyer, even for a smaller estate is a good idea.

We are preparing our estate so it is easy for kids left behind to handle.
  • Papier Oct 3, 2011 @ 10:42 pm | delete
these are all good reminders of a task I am now performing. I recommend researching your county superior court's website for pertinent information. The requirements differ for a large estate, and for one under 60,000 or under 100,000 in our state. A nonprofit legal assistance organization has posted excellent downloadable forms to take care of a small estate, in our county. Most states have similar legal nonprofits to which to turn for the forms.

I have aging family members and will also have to eventually deal with it, too. Thanks for your info and explanation of terms.

Great information about a subject that is complex and time consuming. Thanks for sharing.

I wish everyone could read this lens about executor duties. As a California probate liquidator I have sat in numerous courtrooms to buy assets from probated estates. I'm always shocked at how few people engage in estate planning and leave their families with a mess to clean up while they are in the midst of grieving.
  • mountainstevo Aug 22, 2011 @ 5:52 pm | delete
    Everyone should have this information.
  • hysongdesigns May 27, 2011 @ 8:12 am | delete
Thanks for this info. My mom has made me her executor since dad died and the thought in the back of my mind was so what does that mean? I knew your job is to 'settle the estate' but at least now I have some idea of how to go about doing that!

I am an American living in the UK. The laws are NOT the same between the two countries, and estate taxes here are much higher. I dread having to deal with it here--in Texas, my grandfather's very well prepared estate took about 18 months of determined work for my mother to settle. It will be harder here.

Good lens. My boyfriend's father died about a year ago, so all the responsibilities that come with the loss of a loved fell on his shoulders all at once. I hope I don't have to deal with anything like that anytime soon, but the fact of the matter is that my parents are aging and I need to be prepared for what is inevitable. Thank you for writing this.

Doing estate planning can require some direction. Good write up here, good to keep in mind how a state like Virginia might affect how you go about it.
  • JaguarJulie Sep 10, 2010 @ 7:01 pm | delete
OMG, I'm thinking that this will be something I need to know more about some time in the future. When our dad died, my sister in Columbus, Ohio took care of these duties.

One of the best organized lenses I have seen! Not only it's incredibly informative on topic that people try to avoid it's also nicely designed. Now I just have to learn make those handsome shaded frames.
