Fairfax DUI

Driving Under the Influence, or DUI, is a criminal offense in the state of Virginia. If you are suspected of driving under the influence of alcohol or intoxicating substances, you could face DUI or DWI charges. Consulting with a Fairfax DUI Attorney should be the first step in preparing your case.

The moment a police officer is given a reason to pull you over, even speeding, you are under investigation. Whether your driving behavior was what led to the suspicion of DUI or if it's the scent of alcohol when the officer approaches you, they are collecting evidence on a potential criminal charge against you. How you answer their questions, how you look, and even how you smell can all play a role in your ultimate arrest for DUI. You will likely be asked to submit to a series of field sobriety tests if the officer believes you are under the influence. Tests including the One Legged Stand Test, Walk and Turn, and Horizontal Gaze Nystagmus test are all used to assess your state of mind. Usually, a police officer will also ask you to submit to a breath test.

A breathalyzer test is used to determine your blood alcohol concentration, or BAC. The BAC is used to analyze the amount of alcohol present in your body. If the result is greater than 0.08 (the legal limit) you will be arrested for DUI. A local Fairfax DUI attorney would recommend that you be cooperative as possible with police but refrain from making incriminating statements. Invoking your right to remain silent is suggested.

The penalties you face for a Fairfax DUI are dependent on a number of factors including how many prior convictions you have and your BAC at the time of your arrest:

First Time DUI

  • $250 in fines

  • License suspension

  • Alcohol Safety Classes

First Time DUI with BAC between 0.15 and 0.20

  • + 5 day mandatory jail sentence in addition to prior penalties

First Time DUI with BAC above 0.21

  • +10 mandatory jail sentence in addition to prior penalties

Regardless of your BAC, the penalties for a DUI are severe. Anyone facing such charges is urged to contact a Fairfax DUI attorney for a consultation.
