Fighting foreclosure feels like the life is being sucked right out of you. There is nothing worse than the looming threat of losing your home. I, like millions of you out there, are in the same position. I keep saying "it'll get better" or "the bank has to understand" and perhaps it will and they do but the worst thing you can do is sit idling by and do nothing. Learn what steps you can take in fighting foreclosure that can be the difference between saving and losing your home.

Questions to be Asked as You're Fighting Foreclosure 

Are you worried about keeping up with your current payments? Maybe you are already late and very close to going into default or perhaps you have already reached that point. Is your loan soon due to be reset to a higher payment level? When fighting foreclosure there are many questions you may be asking, such as:

* Is the law on my side or not?

* What is the latest new legislation in Congress going to do for homeowners facing foreclosure?

* How can I get my lender to agree to let me have more time?

Here's what can go wrong when a mortgage lender sells your loan and doesn't tell you. One lender is moving towards foreclose and wants to kick you out, while the other is telling you they want to negotiate a loan modification. This is something that every homeowner should be aware of.

Find Out Who Owns Your Note as Your Fighting Foreclosure 

Make sure the lender who is foreclosing on your home is the actual holder of your note. You must send a 'request to produce the note' to your lender in which they have 30 days to respond. If they do not respond then you can take them to court to get them to come up with the proper documents. This can buy you some time to work on a re-payment plan but it will also protect you as you would not like to find yourself in the situation above.

Also, watch for any hidden fees. Some lenders will try to collect sums of money in which are made up to increase their bottom line, such as, foreclosure fees, pre-bankruptcy fees, etc. Ask the lender to show proof that these fees were indeed paid. Fighting Foreclosure is just that...be active and find out all you can in order to stop foreclosure.
