What is Gestational Surrogacy?
Is the baby related to the surrogate mother?
The intended parents, that is, the actual, biological parents of the child will go through an egg retrieval and sperm donation for the creation of the embryos. These embryos will then be transferred, or implanted, into the womb of the surrogate mother.
The gestational surrogate mother will carry the child for the length of the pregnancy and upon delivery, the child will be given back to its biological parents.
The baby is not related to the surrogate mother in any way.
Gestational surrogacy is legal in most states. Both the surrogate and the intended parents need legal representation.

Why more and more intended parents are looking towards surrogacy instead of adoption
The Waiting List
Parents who choose to adopt have to go through mountains of paperwork, multiple home visits by agencies, and in most cases several years of waiting in order to adopt a baby of their own race. Since most couples are in their late 30's or older when infertility becomes an issue or realization for them, this can put them into their late 40's or older before they have the opportunity to adopt. Many agencies will not allow parents in this age group to adopt.
Adoption is Uncertain
A set of intended parents may spend countless amounts of money on lawyers, living expenses, and medical bills in preparation of an adopted child, only to have the birth mother change her mind at delivery. With gestational surrogacy, the baby is never legally the child of the surrogate mother, so this factor is not an issue.
Is it their responsibility?
Many people who have never walked in the shoes of infertility are quick to say that infertile couples "should" adopt children in need instead of turning to surrogacy. But why? Who made the rule that if you are having trouble conceiving, and want to become a parent, you have to adopt someone else's child instead of seeking assistance to have your own? To those people who feel that adoption should take place instead of surrogacy, I encourage them to adopt a child themselves.
Their Own Child
With surrogacy, couples who are having trouble carrying a child to term have an opportunity to finally have their very own, biological child. They can hold in their arms the baby that will carry on their bloodline, and will complete their family.
It Costs as Much
Adoption, with all the uncertainties, can end up costing as much or more than surrogacy, depending on the situation. With surrogacy, the legal process is not as complicated (in most circumstances), and not as time consuming.
The Surrogate WANTS to Help
With adoption, the birth mother is usually experiencing a difficult time in her life. She has had to make a life changing decision for herself and her unborn child. She is not in a comfortable place in her life. Surrogacy is the opposite. Surrogate mothers volunteer to be surrogates because they want to help another family. They are in a completely joyous point in their lives, in a loving, and giving spirit.
Gay Parents
In some states, adoption is difficult for gay parents. Surrogacy is an option for these parents in many many places, as there are not as many hoops to jump through, and again, the child is biologically related to one parent. For a gay couple to use a gestational surrogate, they would also need to obtain an egg donor.
