Contract Law Essay Question 1)
On 1st January 2000 Adam and Belinda entered into whereby Adam agreed to build an extension to Belinda's house. The completion date for the building works was 31st July 2000. Advice Adam and Belinda in the following separate situations: A) Adam scheduled the commencement of the works for 1st March 2000, but during February he realized that, in the light of labor shortages and increases in the prices of raw materials, he had grossly underestimated the cost of the building work. He has now been approached by Jack who would be willing to enter a much more valuable contract with Adam, but performance would be required immediately. B) Unknown to Adam and Belinda, her house has been subject to an order for compulsory acquisition by the local highways authority on 21st December 1999. The site of the property was apparently required for Road widening purposes. C) Adam informs Belinda that he cannot perform the contract because he only has two earth moving machines and one of those machines has been destroyed by fire at his yard. The cause of the fire has not yet been established. The other machine will not be available because it has been allocated to performance of other contracts.

Contract Law Essay Question 2)
Carewatch Property Services Ltd (hereafter CPS Ltd) recently purchased a luxury apartment block known as Lucky Mansions. The company has retained responsibility for the common areas (including the reception area), all of which are managed by the company.

All the apartments are currently leased on a 99 year lease.

CPS Ltd recently engaged Quality Renovations Ltd(hereafter QR Ltd) to upgrade the entrance area. There are no exclusion clauses in the original contract between CPS Ltd and QR Ltd.

QR Ltd's employees arrived at Luck Mansions on 1st October 2005. Before starting work one of QR Ltd's employees affixed a notice on the wall of the reception area stating "For the duration of the renovation work QR Ltd except no liability for damage to property or injury to persons howsoever caused". The worker began removing a large and valuable chandelier from the ceiling of the reception area. However, he realised that he didn't have the necessary tools to complete the task. He decided to return to the company building to collect his tools and then go straight for his lunch-break.

During the "lunch-break" period two of the Luck Mansion's tenants, Miss Happ and Miss Adventure arrived at the apartments. They began walking to the lift in the reception area. As they passed under the chandelier it broke free from its mountings and hit Miss Adventure on the head and Miss Happ on here right arm causing a severe fracture. The chandelier fell to the ground and was destroyed.

Subsequently Miss Adventure died in hospital and Miss Happ suffered permanent disability to her right arm.

Notes
Miss Adventure's family intend to sue QR Ltd or CPS Ltd for the death of their relative.
Miss Happ intends to sue OR Ltd or CPS Ltd for compensation for her injuries. CPS Ltd intend to sue QR Ltd for the cost of replacing the chandelier.

Questions
Prepare a report for the managing director of QR Ltd on the following:

Question 1
Discuss the use of the law of negligence to provide compensation for Miss Adventure's death and Miss Happ's injuries. It should be noted that Miss Happ is a concert pianist and will not be able to play the piano again.

Question 2
Discuss the incorporation and effectiveness of QR Ltd's attempted exclusion clause to avoid liability for the Miss Adventure's death and Miss Happ's injuries and the damage to the chandelier.

Question 3
Discuss the use of the Occupier's Liability Acts 1957 and 1984 for providing compensation for Miss Adventure's death and Miss Happ's injuries.

Fred arranged with Len, a retired Lecturer in history, to give Fred's son, Simon, a course of two one-hour lessons a week for ten weeks to prepare him for his final year History exams.

It was agreed that Fred would pay Len £250 at the beginning of the course and a further £750 at the end. After five lessons, Simon had a nervous breakdown and was obviously not going to be able to take the examinations.

Fred therefore cancelled the rest of the course. Len had spent a considerable amount of time preparing the classes and had bought the latest edition of the set text books. Advise Len...
