According to the California Vandalism Law, under Penal Code 594, the definition of vandalism is, "Every person who maliciously commits any of the following acts:
  • Defaces with graffiti or other inscribed material
  • Damages or
  • Destroys the real or personal property of another
  • According to the LAPD, most vandals are young people -- from grade schoolers to teens to young adults -- who damage property for one or more of the following reasons:

    Boredom
    Anger
    Revenge
    Defiance
    Alliance

Vandalism can be a controversial topic however, because there is a debate for some as to whether certain forms of graffiti can be artistic.

In California, vandalism is considered a "wobbler." That means that it could either be charged as a misdemeanor or a felony, depending on the amount of damage. While the Judge could put you in jail for either, it's much more likely that jail time would be given for a felony. However, given that he has no criminal history, it's not likely that he would go to jail. Much more likely would be probation and restitution (money) paid to the city or state for the damage.
