Don't Fall for Their Games - err Illegal tactics

Midland Credit Management buys old debts in bulk and then abuses consumers through illegal tactics to get them to pay debts that they are not entitled to collect in any way but intimidation.

Many times they will hire outside collection agencies such as FBCS Collections to work the accounts before they attempt to abuse the court system and arbitration to try to collect.

Not so. SOL will only start if you make a (new) payment. But it is better not to talk to those collectors at all over the phone. Just ignore them. If they got your number, they should have your address. Wait until they send your some (official) correspondence validating your (alleged) debt. Better yet - block their phone numbers on your line.

Mostly, I am horrified that the man came through a latched gate, into my backyard at dusk today. It is of my opinion that with the economy in its current state, foreclosures & failing businesses on the rise, we will see a continuance of shysters such as these praying on those who struggle everyday to just to make it to the next. We all need to stay diligent in putting organizations such as these in the public eye so that they conduct business fairly and ethically.

I talked to a Kevin and told him the debt is 10 years old and out of statute for open ended account (credit card). I also told him my only income is social security and told him I know he cant take it. He told me they will take me to court anyway to try to get money. I taped the conversation and when I told him I was (didnt have to, I live in Ohio) and he told me I am not allowed to do that. However, he never told me to stop taping and continued to talk to me for another 5-10 minutes. That gives me the right to use in court as he told me they are sending me a summons now. I wrote a validation letter to them today and will be mailing out registered tomorrow. I refuse to go down without a fight, and I told him so.

I served them with and order to show cause. They won't fax or send me any of the paperwork. I never was served so I of course missed the court date. My bank account is frozen. No one wants to answer any questions or show me any proof. So they better make it to that court date with some evidence, real evidence and some explantions as to why the process server lied as well as why the sent their fake notice of restraint to the bank that was not signed or notorized. Yes, my bank gave me a copy for my records. I had to go to the court to get all the other paperwork that was actually filed against me 6 MONTHS AGO!! Why am I finding out just now?!?!? These people are complete losers and from what I have been reading they better be ready for me and my lawyer because this time I will be showing up to court (now that I know when it is!!!). They want to play hardball, lets do this!!! They messed with the wrong girl. To be continued...

Original creditor "accidentally" sold it to MCM so they don't have any way to provide a receipt. They have been posting negatively every month since Aug. 2007. My credit score is now in the toilet and lower than it was when I first started repairing my credit by almost 100 points!

Can I sue for defamation of character since this debt has been paid and I have proof?

I will now sue them in court for violating my demand to cease & desist 15 U.S.C. §1692c(c).

Midland sued me in November. As an experienced paralegal, I know how these folks play. I filed and answer with affirmative defenses. In addition, since they included many inappropriate statements in their complaint under the local court rules, I filed a motion to strike portions of their complaint.

They're running. They just sent me a proposed stipulated order of dismissal.
I've responded by asking them to make it a dismissal with prejudice. NO ONE should let this company harass them. You CAN beat them.

Next, I'll move to get them off my credit report (particularly since their reported information is blatantly inaccurate and false)

When I asked for validation the first letter they sent me said that they wanted to help settle the dispute and asked me to send them any reciepts or proof that I had to bsck my claim. I sent them another letter detailing that it was not my responsibility to prove; it was theirs. Of coursc, they could not prove it and did not respond to my letter. I sent copies of everything I had sent to them to each of the three credit bureaus detailing my attempts to have the debts validated and within 30 days all three were removed from my credit report. Just remember, THEY NEED TO PROVE IT, HAVE THEM VALIDATE BEFORE YOU PAY AT ALL.

To top it off they were both over 7 years old. As soon as the credit bureaus contacted Midland for clarification Midland immediately updated the opening date of the account to reflect 2008. In my opinion this is not bad business but illegal.
