The Making of the US Constitution

The US Constitution, our founding document, was well researched, hotly debated, finely crafted, and backed up by copious study.  The supreme goal of the writers of the constitution was to preserve freedom in the United States throughout the generations by keeping the federal government small and with limited powers.  They knew that the natural inclination of men is to try to acquire more power and the founders tried mightily to prevent the subverting of the constitution in this respect.  Do you know that the constitution gave the Executive Branch (President) only 6 powers?  The Legislative Branch (Congress) only has 20 constitutionally sanctioned powers, and the Judiciary ( Supreme Court) has only 11.  Every other power that is not enumerated here is supposed to be reserved for the states.  Do you think each of the three branches of government has overstepped it bounds?  Oh yes, and that is the cause of many problems in government today.

On this page and on subsequent pages, I hope to show you the study and care that went into the construction of our Constitution.  It is not a random, antiquated, or obsolete document.  The Constitution was built to last and has been important to the entire world.

The Political Spectrum

Left and Right, Tyranny and Anarchy

When we think of a political spectrum we think of something like this:
Left< (Communism)-----------------------Moderate------------------------->Right (Fascism)

This is not how the founders saw it. Their spectrum looked more like this:
100%< (Tyranny or Ruler's Law)---------------The Balanced Center----------------> 0% (Anarchy or No Law)

The aim of the founding fathers was to find the Balanced Center and chain it down with checks and balances.

Ruler's Law

What does Ruler's Law mean?

1. The ruler has all power
2. Divides people into classes
3. The ruler owns all property
4. The people are subjects to the ruler
5. Power comes from the top down
6. People not allowed to govern themselves
7. People have no inalienable rights (given by Creator)
8. Government is at the whims of men
9. No legislative body
10. Freedom is not considered a solution to anything
11. Blood and terror

People's Law

What does People's Law mean?

1. All people are freemen
2. You get laws and leaders by common consent
3. Power is not allowed to accrue to one person (tyranny)
4. Separation of Powers
5. People organized into small manageable units
6. People have inalienable rights given by Creator
7. Solve problems locally

The constitution was designed so the federal government would be limited and the people would be empowered. The founding fathers had been living under the tyranny of King George and wanted to make sure we would never live under tyranny in America.

A central government not strong enough



The first attempt at a national government was the Articles of Confederation. This almost caused us to lose the Revolutionary War as it was too close the the anarchy side of the spectrum. The Articles of Confederation did not include a president, a court, or the power to tax, so the government was unable to fund George Washington's army at Valley Forge who were cold and starving. The government was too weak. The founders knew that the government had to be moved closer to the balanced center.

Sources of inspiration

The founding fathers came from many different backgrounds, everything from frontier pioneer to landed aristocracy. They came from different churches or none at all but all were well grounded in the Bible, especially the Old Testament. They all had respect for the teachings of Jesus. The fact that stands out is that they were all extremely well read and well educated. Some had been taught at home and others had attended Harvard but they had all read many of the same books and had studied the same thinkers. They drew inspiration from Cicero, Polybius, John Locke, Coke, Blackstone, Montesquieu, Adam Smith and Thomas Hooker. From the transcripts of the Constitutional Convention and their personal writings, we can see that they were well educated in the art of nation building and in history. Our government is modeled mostly on the ancient Israelites and the Anglo Saxon civilization.

The constitution is still very much relevant - maybe more now than ever before. But the US govt has steadily been whittling away the powers given by the constitution (by enacting laws that go against the clauses and amendments) leaving the people with no power at all.

Very muchj relevant. Although the present government has far surpassed it's LIMITS according to the Constitution and Bill Of Rights the citizens of America are starting to demand that the government BACK OFF or face "We The People". We are the rulers not the subjects.

As long as we still have an active Supreme Court to interpret our laws according to the Constitution then it is definitely relevant. It also has the ability to be amended so it can keep up with the times.

I will always be relevant and we should fight as hard as we can to keep it that way. All politicians and Supreme Court justices should be tested and retested on all of it's parts and meanings and be forced to uphold it.
Right now it's being tossed aside and stepped on & it has to stop.

I'm Canadian, but I've been under the impression that the U.S. Constitution has been severely trampled upon and that your rights are being taken away quickly. I'm probably not answering the question correctly, as it was asked, but would have to say I believe it is becoming obsolete as your rights are being striped away. Correct me if I am wrong.     I believe the U.S. Constitution was created by your founding fathers to empower the people, so they would have authority over the government, whereas the opposite occurs today. Today most Americans fear their government and the quasi-fascist corporations that are stealing the taxpayers' money with bailouts. Fascism exists when government and corporations work hand in hand to their benefit and not the public's. The Corporations and government officials pocketed the profits when those companies and bank stocks were making money, IOW profits were privatized but when went they went to the brink of collapse, the citizens ended up footing the bill. It's a win win for the corporations and banks and a lose lose situation for the U.S. taxpayers. Wake up people.

    I'm glad you got a purple star, I would have hated to miss this lens. Very well done, instead of swinging from left to right true freedom requires that we all balance in the middle.

    Having recently watched "John Adams," the Constitution is fresh in my mind. Unfortunately, many of our elected officials and judiciary do not respect its provisions. The founders were brilliant and should not be underestimated. Nice work, as usual. Blessed!
