Is mp3obsession.com legal?

MP3 Obsession.com claims to be a 'cheap mp3 comparison website'. So what does that mean?

Well, after going thought the site, they seem to offer cheap mp3s in much the same as confused.com offer car insurance. They stock millions of mp3s - albums and singles - which you can search through using their search box or the artist, album, genre and soundtrack tabs at the top of the site.

Once you have found something you want to download, you are given a list of websites that you can get it from, along with the price, their payment methods and a chance to read the full review of the site. Click on the site you want to buy from and you're taken to their site to purchase your mp3s.

The site has a blog, site comparison table, offers page and faq too. They also feature artist biographies, discographies and pictures.

This all seems good and well, but is it legal?

Well, as the site is not actually selling mp3s, yes, it is. The sites it recommends to users are where the legality of it comes in.

So, is it legal?

Enough chatting, lets get down to business....

Is mp3obsession.com legal or not? Well, reading their faq, we are told:

Yes, all of the sites we review are based in Russia, and Russian laws allow you to to download mp3's as long as they are for personal use only and not distribution.

So what does that mean exactly?

Well, if we dig around on the sites that mp3obsession.com have reviewed, we find this from MP3va, their third recommended site:


We ask you to give your attention to the fact that all tracks and albums distributed through Mp3va are intended only for private listening. It is forbidden to use the tracks or albums from this site, or their fragments, for commercial purposes, or to broadcast by means of digital or analog liaison channels (radio, video, TV), to transfer to third parties, to duplicate, to place on local networks or on other Internet sites
The activity of site Mp3va is carried out according to the legislation of the license agreement # 33/3M-08 of the Rightholders Federation for Collective Copyright Management of Works Used Interactively (NP "FAIR"). Service Mp3va pays full-scale author's royalties to owners of pieces of music, trade marks, names, slogans and other copyright objects used on the site.
Service meets the requirements of the majority of the states of the Europe and the USA, although it is not possible to guarantee the legality of the work of Service in all States. In such rare instances the responsibility for use of Service lies with the user.

That's all a bit boring really!

So let%u2019s translate that into English:

You can download what you like from them, but it has to be for personal listening. i.e in your car, bedroom, iPod, whatever you use. You can't play it as a soundtrack to a movie, or on your website for example.

MP3va pay royalties on the music, so the artists are getting some money. They do cover themselves though, by adding that some countries may not allow this type of downloading, and in such cases, you, the downloader, are responsible, not MP3va.

Great news! So, what about the other sites they compare?

Legal Sounds
This is basically the same thing; you cannot use the songs for distribution or for commercial use. So don't go blasting them out on your MySpace page! Legal Sounds pay licence fees "subject to the Law of the Russian Federation "On Copyright and Related Rights". So again, Legal Sounds is a legal service, offering legal mp3s to download.

MP3 Million
Again, the same thing. MP3 Million pays license fees for all materials downloaded from the site. "All these materials are solely for personal use." So again, don't go using it where you know you shouldn't and you're onto a winner.

Soundike
Soundike are a bit different, and have more than covered themselves, stating if there is a difference is laws in countries, you're responsible for the music you download if you're country doesn't allow it. But the same basic principles apply again, if only have the songs for personal use, you're fine.
