Nicaragua Residential Agreements 

Residential Rental Agreement: In Nicaragua the Income of Properties is based on Article 2810C of our civil code. It literally says:

'' Leasing is the contract of which two parties mutually agree to grant or transfer temporarily the use or enjoyment of one thing and the other to pay for this use or enjoyment.

The two agreed parties also set out a specific price. The 'Lessor' is the party that is giving or leasing the 'thing'. The 'Lessee' is the party that is receiving the 'thing'.

This Contract cannot be for a term of greater to ten years. The exception to this ruling is for rustic and cultivated property. This exception is stated in the Article 2820C of the civil code.

The Lessor is obliged to guarantee the use and enjoyment specific 'thing'. The 'Lessee' also the right to Sublet or to Lease to a Third Party. The Sublet can be for either total or partial of the original 'thing'.

Insurance 

Insurance on this 'item' depends on the Agreement set out by all parties. The Insurance is to include any damage and/or reasonable deterioration of the 'item'.

The 'Lessee' can carry out small repairs to help maintain good the 'item' in good condition. The 'Lessor' is not necessarily bound to pay for these costs, but this is optional (Article 2899C).

The 'Lessee' can be responsible for the payment of all or part of the utilities (water, electricity, collection of trash) as well as cleaning. An agreement must be made for the portion or portions which the 'Lessee' and 'Lessor' will pay for.

Expectations 

Rights and Obligations:

- The 'Lessor' is to provide the 'Lessee' the item in good condition for his use. It is also to be in proper hygienic condition as well as provide reasonable security.

- The 'Lessee' is to maintain the item in good condition, with the exception of normal deterioration. He/she is also to maintain necessary to repairs in order to keep the normal functionality of the real estate.

- The 'Lessor' is not to hinder the use of the real estate to the 'Lessee' and is to respond to any matters of urgent repairs.

- The 'Lessor' is to guarantee the use and peaceful enjoyment of the real estate for the entire of the agreed contract.

- The 'Lessor' is 'make-ready' the real estate in the time agreed.

The 'Lessor' is NOT at liberty to do the following during the time of the agreed upon Lease:

- Change any form of the Lease.

- Enter onto the leased property for any reason except in the case of emergencies.
If the Lessor does not comply with the necessary repairs to the leased property, the Lessee has the option to appear before a Judge to resolve any short-comings or to terminate his/her lease.

The Lessee 

Rights and Obligations:

- To submit the rent monies to the Lessor in the time agreed.

- To report any damages of the leased property to the Lessor or he/she is liable to pay damages due to negligence.

- To use the leased property ONLY for the purpose as set out in the Lease Agreement.

- To pay the all rent monies to the Lessor beginning the first day of the contract until the last.

- The rental monies are to be paid in full at the place agreed upon in the lease contract. If the location of payment is not stated; it is to be paid at the house or the office of the Lessor.

- If by any unforeseen circumstances the 'Lessee' is unable to pay monies to the Lessor, he will have the right NOT to pay any or part of the rental monies until such time as the impediment is resolved.

- To conserve and to take care of the leased property.

- To return the rented property in the same 'like manner' as it was received, upon the end of the rental agreement.

The Rental Agreement may be terminated for the following reasons:
- Death of the Lessor or the Lessee.
- At the end of the term of the rental contract as was completed by both parties.
- By mutual agreement of both the Lessor and the Lessee.
- Nullity.
- Confusion.
- Loss or total destruction of the leased property for any unforeseen circumstances.
- By expropriation of the leased property in the case of public utility.
- By judicial sale.

Lessor vs Lessee 

The Rental Contract

The Lessor can terminate the rental contract due to:
- Lack of payment of rental monies.
- Payment not being made on the dates agreed.
- The Rental Property not being used in the appropriate agreed upon manner.
- Making changes to the Rental Property without the consent of the Lessor.

The Lessee can terminate the term of the contract due to:
- The Lessor not supplying the rental property to the Lessee in good condition.
- Total or partial loss of the rental property caused by the Lessor.
- Previously existing defects or hidden problems not mentioned to the Lessee at the time of the Lease Agreement.

The Leasing of property in Nicaragua is an important part in the domestic economy. Generally, the prices of Residential Leasing depend on the location and size of said property. Prices also vary if the property is furnished or not.

Nicaragua Real Estate 

In Nicaragua, at the time of this writing, there are no real estate boards to assist in the governance of real estate transactions. The availability of real estate either for lease or for sale has be done by primarily by word of mouth.

The previous lack of laws and governance did cause for problems within this industry. The past and the current governments have been working hard to correct the situation.
