Parlimentary Supramacy

Parliamentary supremacy, Parlimentary soveringty, legislative supremcary. Call it what you will, It bascailly means "Hooray for ourside". Who's side may you ask, well...... Let me explain.

The reason that im doing this blog, is not becuase i think im the greatest, or that my opinion is supreme. The reason is....... because I have an assignment to do and so far while researching on this issue, the word, "SUPREMACY" isn't a matter of opinion" Broad Walk.

Parliamentary Sovereignty

When I refer to parliamentary sovereignty. Let me break it down....... In the UK we have a separation of power in our constitutional. A constitution can be described as Institutes or documents which enforce rules, regulates society, govern or dictate the running of our society for example..... Law aka statues aka legislations or Treaties can create Constitution principles such as the Bill of Rights in America from 1776 to 1789, constitutional documents. Anywhoooooo back to the UK instead of principles we have three bodies. Government, Parliament and Courts I'm not going into politics or history such as the Magnacata or common law etc... So I will further on to only speak about Parliament, who legislate constitutional principles and other legislative matters. Parliament has a bicameral legislative separation, HOC (House of commons) This is where the MP's are found & HOL (House of Lords). Lord Sugar-expert in business etcc Judges....Bishops......Hereditary....... I could go on...... Finally we have the Queen in parliament. The Royal assent as such and other prerogative/monarchy duties & roles so to say.

Rule of Law

Now im leaving this 1 blank and giving you this to read.

"The rule of Law requires that every person be protected from invasion by the authorities of his right and liberty. But the preservation of law and order in which the rule of law also depends, requires that those protection should not be framed in such a way as to make it IMPRACTICABLY to bring those who are accused of crime to justice (OKAY) Let me explain with this link this clip......

ROL

Rule of Law

'parliamentary privilege' - the convention which allows MPs to speak in the House of Commons without fear of slander actions - protects them from criminal prosecution for theft.

They were yesterday denied a full Supreme Court hearing by Lord Chief Justice Lord Judge - but are allowed to ask the country's most senior judges to rule on whether the 1688 Bill of Rights allows courts to hear their cases.

WHERE DOES THIS LEAVE THE RULE. This clips explains it LOL

Parliamentary sovereignty

EU (European union) 1951 EC (European community) Act 1972

"After UK accession to the EU, parliament could no longer past legislation INCONSISTENT with EC (European Community) law. In other words, any parliament which incorporated the Treaty into UK law would bind itself and its successors not to breach EC law in the FUTURE.

Conclusion: If Parliament enacted legislation purporting to withdraw the United Kingdom from the community and the UK courts then refused to enforce the Act. United Kingdom joined in 1973.........Can they bind their future successors "Mr alder that's politic's not law"
