To pay or not to pay that is the question...

Paying a collection agency may not be the best way to repair your credit or protect your privacy.  There are situation that you may find your self in and have to pay a collection agency to to accomplish a short term goal such as buying or refinancing a home.

If you are just in general collection agency hell then paying may do you more harm than good.  While I would NEVER PAY A COLLECTION AGENCY. How you wish to handle your individual situation is a personal choice.

If you do need to pay them off make sure you do it in a way to not cost you future heart ache and pain.. 

Do's and Do not's on Paying a Collection Agency 

there is a right way and a wrong way to pay them

If you are trying to accomplish a goal such as buying a home and a condition of a loan requires a collection account to be paid off and you do not wish to postpone the transaction be careful in how you handle it.

You may be doing the right thing and it cause you more problems than it is worth.
  • Don't give a collection agency your credit or debit card number or checking information over the phone. There are to many stories on the Internet where people have paid collection agencies this way and dishonest collection agency personnel misuse this information.

    The best way to pay them is with a money order or through a third party such as a closing agent or attorney.

    If they insist you use quick collect or money gram chances are you are being scammed plus the fees for these services are draconian. Buy a money order and overnight it to a specific contact at a collection agency the cost of this should be less.



  • Do make them put it in writing that you will never hear about this debt again especially if it is a reduced payoff!!

    Many times collection agencies will offer you a reduce payoff on a debt only to resell the portion you did not pay. There are many collection agencies that are in the business of buying old debts and "deficiencies" like this get packaged into portfolios of junk debt.

    A debt that you clear today may pop up on you years down the road.



  • Do ask them to delete the trade line. You may be able to accomplish this towards the end of the month when they are trying to close out their numbers. You have always heard that the best day to get a good deal on a car is the last day of the month. It is the same with a collection agency.

    Because you are not going to give them financial information over the phone start a few days early. If they agree to this make them put it in writing!!



  • Never take anything they say over the phone as reliable it bears repeating. Do not give financial information over the phone and make them put everything in writing!!

There is no debtors prision 

If you are in collection hell and have no immediate goal of home purchase and you have some time to deal with you financial woes. The best advice is to get Dave Ramsey's book financial peace and start looking at way to enforce your rights allowed by Federal and State laws when dealing with a collection agency.

While this is a moral mind field it is not illegal to owe money. It is illegal to be harassed because you do. This country was a penal colony where people got 'transported" because of debts or crimes.

If a collection agency harasses you on the phone and threatens legal problems such as jail it is time to hold them culpable!!

I work in the collections department of a personal loans office, and I'm so sick of being the "bad guy". All I'm trying to do is get my boss's money back, that he lent people. I can't get over the number of people who think it's okay to take someone else's money, then do something like turn around and disconnect their phone and close their bank account. Then they get mad at me for calling them non-stop, or calling their work. What do they expect? This money wasn't free!

I understand there are people who legitimately don't have the money to pay us back. People who lose their job or become disabled. We are more than willing to work with these people and put them on a payment plan. But those people are in the minority. It seems everyone uses that excuse. Then you see them at the mall buying up a storm.

My boss has three kids to support. Maybe if people thought more about the people they're borrowing from, they'd think twice about skipping out on paying them back.

The people who call in to complain are the ones that had their taxes taken, disability offset, or their wages garnished. This could have been avoided by one term, ACCOUNTABILITY!

Not everyone stops paying their bill just because they choose to.

Anyone who makes a living on people's misfortune represents a lowly form of life. I understand there are certain cases where debt is legitimate, but in most cases you are looking at unfortunate situations where these slimeballs use scare tactics on ejecting families from their homes and putting people in jail to profit. Credit Card companies have enough data to know who to target (from debt/income ratio) and who to stay away from, but not only do they market/sell directly to those that could get themselves in trouble they aggressively go after them! (College students, low income, etc.) Representing "Freedom and I WANT IT ALL" It's a business, I get it, but they have an ethical responsibility to DO BETTER, and businesses who PURCHASE DEBT FOR THE SAKE OF PROFIT are simply evil.

I agree there is quite a bit of abuse in the industry but that seems to be a problem with the laws on a state by state basis. Proper enforcement seems to be the answer. In the meantime, consumers need to be wiser in the use of credit and not be quick to blame the collection agency for their own failures at promptly paying their debts. I was recently told of one debtor who was living in a million dollar home and failed to pay a $11,000 debt to a doctor even though the insurance company had sent the debtor the check which the debtor cashed and used to go on vacation. Now they did not have the cash and was calling for a settlement offer or payment arrangement. There is good and bad on both sides of the equation but in the end it comes down to the borrower and responsibility.

I have consulted with dozens that hold strict adherance to the FDCPA regulations and continually send their collectors to advanced training in order to not break any laws. Also, I have overseen the implementation of telephone voice recorders to maintain the integrity of what is said between the debtor and collector so that it may be reviewed in court if the need arises. And yes, they give the debtor a mini miranda to inform them that this is an attempt to collect a debt and that calls are recorded for quality assurance, etc

The collectors I have seen have gone out of their way to deal with insurance companies to settle debts. As for ID theft, the debtor needs only to provide a police report showing that it was reported and the file would be duly note

Most collection agencies do not want to help especially in situations of id theft or an improper charge. They have one goal to collect money, not help consumers resolve issues. If more took on a consultative role then you would not see pages like this informing consumers on how full of fraud the industry is.

That is simply a stall tactic. The creditor is a business. They have employees and bills to pay like the rest of us. Why should the creditor have to waste additional time and energy away from their daily business to make NEW payment arrangements with the debtor only to continually have the debtor not follow thru with the agreement. Then the creditor will have to call the debtor and ask why the money was not sent in the agreed upon manner and have to listen to another debtor "story". This is why a collection agency is called upon for their services. They are trained to help the debtor find the way to pay their debts. It is better than being taken to court and paying court costs and legal fees.

Far to often the debtor knew that they could not pay for a purchase or service and decided to use credit regardless and then they look for ways to get out of paying the debt. People today have no concept of how to use credit wisely. They simply want everything now and don't care to think if they can afford it. Then they decide to not pay the bill, blame the collection agency and everyone else for the problems they got into. Most collection agencies are honest and are just trying to help the consumer resolve their problem. People simply need to stop making stupid decisions. You know what money you have coming in and what you can afford! Spend Wisely!

Later my family had a medical emergency and I got behind on some bills and then got laided off from my job. I ended up claming bankrupsy. Several years later I got a call from the bestbuy people saying they wanted the computer because the card was a secured debt. I laughed and told her that would be difficalt to give her because different parts of the computer had died during the years. And that they should have called me when I had the bankrupsy. The only thing that still worked and the computer was the case and power supply. She desided to just write it off.
