Paying a collection agency may not be the best way to repair your credit or protect your privacy. There are situation that you may find your self in and have to pay a collection agency to to accomplish a short term goal such as buying or refinancing a home.
If you are just in general collection agency hell then paying may do you more harm than good. While I would NEVER PAY A COLLECTION AGENCY. How you wish to handle your individual situation is a personal choice.
If you do need to pay them off make sure you do it in a way to not cost you future heart ache and pain...

Do's and Do not's on Paying a Collection Agency
there is a right way and a wrong way to pay them
You may be doing the right thing and it cause you more problems than it is worth.
- Don't give a collection agency your credit or debit card number or checking information over the phone. There are to many stories on the Internet where people have paid collection agencies this way and dishonest collection agency personnel misuse this information.
The best way to pay them is with a money order or through a third party such as a closing agent or attorney.
If they insist you use quick collect or money gram chances are you are being scammed plus the fees for these services are draconian. Buy a money order and overnight it to a specific contact at a collection agency the cost of this should be less. - Do make them put it in writing that you will never hear about this debt again especially if it is a reduced payoff!!
Many times collection agencies will offer you a reduce payoff on a debt only to resell the portion you did not pay. There are many collection agencies that are in the business of buying old debts and "deficiencies" like this get packaged into portfolios of junk debt.
A debt that you clear today may pop up on you years down the road. - Do ask them to delete the trade line. You may be able to accomplish this towards the end of the month when they are trying to close out their numbers. You have always heard that the best day to get a good deal on a car is the last day of the month. It is the same with a collection agency.
Because you are not going to give them financial information over the phone start a few days early. If they agree to this make them put it in writing!! - Never take anything they say over the phone as reliable it bears repeating. Do not give financial information over the phone and make them put everything in writing!!

There is no debtors prision
If you are in collection hell and have no immediate goal of home purchase and you have some time to deal with you financial woes. The best advice is to get Dave Ramsey's book financial peace and start looking at way to enforce your rights allowed by Federal and State laws when dealing with a collection agency.While this is a moral mind field it is not illegal to owe money. It is illegal to be harassed because you do. This country was a penal colony where people got 'transported" because of debts or crimes.
If a collection agency harasses you on the phone and threatens legal problems such as jail it is time to hold them culpable!!

- With all the new laws in place... most collectors are not that bad they may have been at one time but nobody wants to be sued nowadays... yeah u may recieve multiple calls to your house, office or cell but that is the automated system dialing those numbers randomly not a individual person... Like with any other profession not everyone is going do their job the way they are suppose to but you can't classify all collectors as the same that is just absurd... how would you feel to on a daily basis be hung up on, cussed out and spoken to in the most rude and disrepecting ways being called names you would never stand for in a face to face conversation and still be expected to deal with the call in a calm and professional manner.. Just like any other american we are just trying to make a living and take care of our familes... if everyone paid their bills that they created there would be no reason for collection agencies however they dont so collections is a necssary evil... the old saying still applies you get more with sugar than you do with salt and this holds true for collections the best collectors are usually not the rude ones and there are some rude ones.... in my experience the frustrated debtor initiates the call going into a negative manner... We are mediators just trying to resolve a issue that is fair for our client and the debtor, sometimes without all the facts and thats not our fault but if the debtor would take the time to try to get the correct infromation across the issue probably would get worked out... people love to bash collectors but if the just look in the mirror and man up they would realize this is a situation they created... noone made them sign their names on those contracts but the individual themselves and when its time for repayment they try everything to deflect the attention from the fact that they are reneging on their obligation !!!! Just food for thought!!

- wondering if collection comapnies can ONLY offer one form of payment. I am leery of giving my banking information to have my payments deducted automatcally from my account. i have heard such horror stories. I advised I would send in money order each month to be received by arrangement due date. They told me no, only way to pay is bu them auto debting my account, they do not take money orders OR mailed check payments. On top of that, I have to pay $8 processing fee each deduction.
Is this legal ?

- Do Your Homework. Most, and I repeat, "most" of the originators of your debt, although in collections, will still work with you and "call off" the headhunters. As collection agencies literally will rape you with costs, eg a $70 medical debt, may end up through a collection agency as close to $300. I believe this should be illegal. Again, even if you received a collection notice, #1 you control the guidelines! Most collectors will not provide you the origination nor original amount of debt they are collecting for, especially when it's sold and sold and sold and sold (this is the collection company's way to keep it on your credit report). Go back through your credit report or if you know where the original debt came from, contact them, see if there is an arrangement you can make directly with them. If this is ineffective, in such cases as hospitals, get a copy of the original billing and NEGOTIATE with the collection agency! Upon making a final payment to a collection agency, submit in writing, a request to abolish or mark as paid within 30 days on your credit report. Keep a copy and watch your credit report. It can be done if you have the time and the money. Don't allow them to "rule" your life.

- There are FDCPA regulations that allow collection firms to charge interest (typically 8-10%) of the balance. As I had mentioned below, if a law firm collector has your file, they equally have their bases covered. They are trained on FDCPA, have validation letters at a touch of a button and have the ability to approve certain settlements and plans (but they need the creditor approval first). Overall, people didn't pay their bills. Sure, there are things in life that can't be controlled, but pushing aside responsibility and blaming, is ridiculous. Understanding, you can't forget a 10 year old debt (because you think it's old) doesn't mean the creditor hasn't filed a lien that could be renewed every 7 years. There is NO statue of limitation on a lien file. Addressing your debt issues early will prevent these matters later.

- I have been receiving calls from an "unknown" number. They leave a message, for my wife about an important business issue and please call "so and so" at 1-800-371-1321. I called to see what was up and the person on the other end answered "this is linda how may I help you?" No indication that I was calling a collection agency. I just hung up. The 800 number belongs to Missouri Medical Collections. I am wondering if you or others have had problems with them in the past. A while back they tried to get me to pay on someones account that had the same name as me. I caught them on this one. Whether I owe or not is not the issue I have, it's the deceitful practice that Missouri Medical Collections uses. Should I just ignore them or should I confront them and file charges?

- I got a medical bill last year, when I called the lab company they told me that I could make a payment plan but that they had a company dealing with payment arrangements, That is when they make me call Steven Business Services. They did a payment plan and everything was good for about 7 months when suddenly they lost one of my checks (payments) and now all of a sudden they wanted the full amount!!!! Why? it was not my fault!!! so they called me and called me, I tried to contact the lab company complaining, cause my intentions were there but this bastards did it on purpose! so here I am, I refuse to pay the entire amount (besides that I do not have the money) and they call 30 times a day and I guess It will affect my credit. BUT I KNOW SOMETHING! This was all on purpose! They were sick of my on-time payments ... they just want it all..... F^&*^&^ck them!

- Transworld Systems is one of the largest and aggressive collectors in the world. From personal experience I have found that they are wrong on the amounts (like I owed zero after my insurance fpaid), but they kept calling my home. I found that calling/email their executives at home, while it did not make it stop, was still very satsfying. One I found on the internet is Kenneth Eissing. - What if the collections agency was told by the credit card company that you refused to pay and they aren't telling the truth. I paid 277.00 for 10 months and was told by the credit company that because I did that my payments would go down. By the end of the next month I was being yelled at by the credit card company that I owed them 354.00. I asked why and what was told to me the month before and they said that the guy was wrong. I told them I could pay them on the first of the month--because I only get paid once a month and he said he would get back to me and then all of a sudden it's with a collection agency. What happens then.

In most states a collection agency can communicate with the spouse. Check your state laws to find out what is required in your state. Your husband is correct, he cannot be pursued while he is deployed, but the debt does not go away. Sooner or later it will need to be dealt with. As far as their settlement offer is concerned, despite what a collector may tell you, settlements are at the discretion of the agency or the collector. Many companies will offer settlements if they have exhausted all other efforts to collect the debt. They may also accept terms in regards to those settlements (payment arrangements), especially if they have been walking a thin line regarding their collection efforts and you can prove it. Check out the FDCPA and your states collection laws. If they are doing anything that even smells like it might be illegal, get documentation (get a recording) and use it as leverage to negotiate the deal you want, not just what they are willing to give.

- What annoys me is that a company sends something to collections becasue they say you owe them money, however ever if you dispute the claim they forward it to collections thinking that you will be forced to pay. Now I am not refering to people that stopped paying on credit cards or actuall money they receved from a bank. I am speaking of contract disputes, or repossesed property that was sold at auctions for a fraction of it's cost. Their the idiots that sold something for a drastically reduced price not me. Any way I want to know how an individual like me can place a collections account against a bank. I want my tax money back from these banks and I don't think they are paying it back at an acceptable rate. Seriously, how do I place a collections against them????

- One thing collection agencies don't won't anyone to know is that if you ask them for thier fax number or mailing address you can that simply write a short letter that you want them to "cesase and disesce". They have to stop calling you. They will give the debt back to the company that is owed the money and will not annoy you any more. It works...

- Actually, depending on the collection firm and state laws, you may be horribly wrong. You may certainly send a CEASE AND DESIST letter but this only forces (especially if a law firm collector has your file) to file a lawsuit and pursue judgment, which included garnishments or a bank garnishment. Collections is certainly deeper now that law firms have began collection floors. They typically demand from the creditor they send the contract due to FDCPA regulations. I would recommend never ignoring a collection letter or thinking a cease and desist will mean to not file a lawsuit. It simply means they will no longer call or mail you regarding collecting the debt, but they can mail you in regards to a lawsuit.

- Medical Debt, Credit Card Charge-Offs and Untility Collections
At one point I had 21, yes twenty one collections on my consumer file.
Since 80% were almost five years into the 7 years 180 Days since collection activity started, i decided to ride out the next few years and not pay anything. This was 1 1/2 yrs ago.
Since the decision:
I have one student loan and 5 low-limit credit cards
I do not miss payments. Ever.
I'm looking forward to the days when the collections will begin to drop from my file leaving only the good-standing revolving and instalment trades.
Between now and then...I'll just deal with the constant phone calls to my cell, office desk, relatives, letters sent to every address I've ever lived at.
I'm crossing my fingers that I make it to the finish line without judgements within the SOL period.

- Collection of any debt is not legal when the junk debt buyer/colector cannot prove he owns or has been assigned that debt via chain of title that reaches unbroken to original contract. Most of jdb-collectors cannot prove it. I KNOW! Most do not care to understand the meaning of NO. We wrote the Certified return receipt dispute letters in timely manner & logged all their calls & transcribed all their lies. We DO NOT engage in any convo with them except to ask their name, company location etc. We NEVER divulge ANYTHING! I KNOW this for a fact. I finally found local South Carolina attorney; expert in US Federal Fair Debt Collection law who took action in Spring 2009 w/ NO $ up front. On two separate matters, lawyer immediately filed suits in local district of US Fed Court for violations of FDCPA. The junk debt buyers & collectors immediately begged to settle. We did; lawyer & we split 50:50. We walked w/ $10,000 USD & never entered Court & never deposed. SWEET! So mr & ms collector ... most of whom have no morals/scruples ... you got squat while we got paid. Here's a real tip for y'all getting harassed by jdb's collectors ... document what they do, dispute them certified also demanding Do Not call. Then wait for them to violate Fed & State law. Do NOT expect your reporting FTC or BBB to gain you a thing. So YOU get a lawyer to SUE their butts. Make them pay YOU. Merry Christmas to all except the scum who chose to work in junk debt-collections.
