Here are some frequently asked questions about Phoenix DUI cases. When I say Phoenix DUI cases, I mean cases prosecuted in the Phoenix Municipal Court. While most DUI charges in the City of Phoenix are brought in this court, some are also brought in what are known as "justice courts" (i.e county courts.) What is my overall opinion about defending DUI/DWI cases in the City of Phoenix?
I have a list of the worst courts to fight a DUI charge. The City of Phoenix is NOT on that list.

While they do not say this, there is essentially a no negotiation of pleas policy. Most prosecutors will tell you the initial plea agreement is the final offer - it will not change. This is not always true, but it is difficult.

If you are convicted , then the judges have the discretion to sentence someone to home detention as part of longer sentences. While it is no guarantee, if an attorney takes certain steps, then it usually is granted.

Since there is such a large volume of DUI cases in Phoenix, there is no one testing methods. Previously they mainly used breath testing devices. However, the primary method has changed to blood testing.

There are generally two phases to a DUI case. First, is the pretrial phase. During that time period the State must provided the necessary evidence needed to defend the case. At the end of at phase, a decision on whether to accept a plea is made. If a plea is accepted the case is usually over. The Second phase is the trial phase. If the decision is made to proceed to trial, then a trial must be set. In the City of Phoenix, this is usually set within two months of the request.
In sum, if the case resolves in pretrial phase it usually take around 3 months. If it proceed to trial, then it usually take about 5 months. Furthermore, certain client have the need to change these timeframes. If necessary we can attempt to shorten or lengthen the time it takes to resolve a case.
