Podsafe is a term created in the podcasting community to refer to any work which, through its licensing, specifically allows the use of the work in podcasting, regardless of restrictions the same work might have in other realms. For example, a song may be legal to use in podcasts, but may need to be purchased or have royalties paid for over-the-air radio use, television use, and possibly even personal use.

About Copyright 

For a work to be considered podsafe, any licensing requirements must allow for the work's free use in a podcast or web broadcast. The licensor must have the legal right and authority to declare the work podsafe. 

There are many types of licensing agreements that allow material to be used in podcasts. Generally, podsafe works provide more flexible, pre-cleared usage rights in comparison with other works that use strongly enforced copyright restrictions and Digital Rights Management (DRM).

Content made podsafe in no way affects the rights of artists and performers to benefit commercially from their works in other ways. 

About Copyleft 

Copyleft style licenses are widely used in the podcasting community and play an important role in the way people share, remix and distribute independent media. In particular Creative Commons' licensed content is generally podsafe providing use is consistent with the applicable license terms. Podcasts are known as "collective works" and are not considered to be derivative works (see Podcasting Legal Guide).

The use of CC licenses has enabled a more open approach to content creation and distribution. This movement is continually developing new avenues for promotion and revenue that purposefully take advantage of innovative digital technologies. As a consequence, DIY producers are gaining more exposure both locally and internationally.

Podsafe content can be found in many locations online including artists web sites, mp3 blogs, video blogs, open media communities, podcast directories, net labels, P2P networks, social networks and BitTorrent hosts. 

You can use the resources mentioned here to learn more about the availability of podsafe content and flexible licenses like Creative Commons. The main aim is to connect you with content creators willing to let you use their works for free in podcasts or web broadcasts.

Podsafe Search Engines 

Tip: To narrow your search for podsafe music try using the phrase "This music free to share under a Creative Commons Music" including the quotation marks. This phrase refers to the actual text used in the CC badge placed on websites. You can use this with any popular search engine, just remember even the same search engine may produce different results regionally ie America or Europe.

Netlabels and the Adoption of Creative Commons Licensing in the Online Electronic Music Community
The Creative Commons licensing model has enjoyed particularly high adoption rates in the online electronic music community. A growing number of netlabels publish original compositions for free online using Creative Commons' music sharing license. To understand this phenomenon, a history of the electronic music scene is presented that identifies motivating factors. The Public Domain

The public domain is an intellectual property designation for the range of content that is not owned or controlled by anyone. These materials are "public property", and available for anyone to use freely for any purpose. The public domain can be defined in contrast to several forms of intellectual property; the public domain in contrast to copyrighted works is different from the public domain in contrast to trademarks or patented works. Furthermore, the laws of various countries define the scope of the public domain differently, making it necessary to specify which jurisdiction's public domain is being discussed.

The public domain is most often discussed in contrast to works whose use is restricted by copyright. Under modern law, most original works of art, literature, music, etc. are covered by copyright from the time of their creation for a limited period of time (which varies by country). When the copyright expires, the work enters the public domain. It is estimated that currently, of all the books found in the world's libraries, only about 15% are in the public domain, even though only 10% of all books are still in print; the remaining 75% are books which remain unavailable because they are still under copyright protection.Kevin Kelly. The public domain can also be defined in contrast to trademarks. Names, logos, and other identifying marks used in commerce can be restricted as proprietary trademarks for a single business to use. Trademarks can be maintained indefinitely, but they can also lapse through disuse, negligence, or widespread misuse, and enter the public domain. It is possible, however, for a lapsed trademark to become proprietary again, leaving the public domain.

The public domain also contrasts with patents. New inventions can be registered and granted patents restricting others from using the inventions without permission from the inventor. Like copyrights, patents last for a limited period of time, after which the inventions covered by them enter the public domain and can be used by anyone.

Creative Commons (CC) is a non-profit organization headquartered in San Francisco, California, United States devoted to expanding the range of creative works available for others to build upon legally and to share.(Creative Commons FAQ) The organization has released several copyright-licenses known as Creative Commons licenses for free to the public. These licenses allow creators to communicate which rights they reserve, and which rights they waive for the benefit of recipients or other creators. Wikipedia is one of the notable web-based projects using one of its licenses.

The organization was founded in 2001 with support of the Center for the Public Domain. The first set of copyright licenses were released in December 2002.
