The space that the files used to occupy is now free space and available for use. The information that comprised your files and data is still there and recoverable.
However, this "free space" will be overwritten eventually and when that happens depends really on a lot of things, such as how this free space is distributed over the hard drive etc...Sometimes also if the file you deleted is very small, it might not be overwritten for a while until another equally small-size file is written to the drive.
Sometimes that available space on your Mac will be overwritten immediately with new data, other times this may take days, weeks or months...it all depends. The crucial thing is this:

If you are attempting to recover files from the Trash, note the following: If you've emptied the Trash or deleted the files with the rm (remove) command, your files and data is recoverable IF you STOP using your Mac right now. This is particularly true if you are currently running low on disk space. The Mac OS X overwrites this little free space very quickly with temp files.

- I am trying to recover documents in my trash which I emptied. Am I correct in understanding that my files/ docs are only recoverable IF I used the "rm command" to delete them? I always drag the trash to my garbage icon then use the menu bar to empty the trash. Does that mean this will not work for me?

- I'm trying to recover a word file and it was not recently emptied form my trash. I used SP to recover my word documents, but the documents it found are not named what I originally named them- just a whole bunch of numbers. Is there anyway to know what these documents are before I buy the registration key? Thanks.

- I'm scared how reliable this is I emptied my usb by putting everything in the trash thinking it was on my desktop but they where older files opps, then I emptied my trash and realised a few days later oops I needed that.
BTW Gina your file might not work because it has only been saved to a usb and not to the desktop ect which word automatically deletes and you can not recover it.
That happened to me once, so annoying...

- If your trash was securely erased, then no. What a secure erase does after deleting the files is to write over the missing space with binary code (0s and 1s) to make sure that nothing is recoverable. When you do a regular empty trash, your file is still there on the drive, but not visible. With secure erases, those files will be non-recoverable.

- The Stellar Phoenix Macintosh Data Recovery software worked like a charm! I needed to recover files on my macintosh that I had accidentally deleted (emptied trash and everything) and it pulled up files from what seems like years ago. The only thing is that although the download to search for files is free, to recover the files it makes you register the product, which means pay for it, and it was expensive ($129.00 from the product site). If you really need to retrieve something you lost or deleted, though, it is worth it. It works and does what it promised!

Recover Mac photo's & files
Select the hard-drive or folder where you missing file was and start the scan. Once complete, you'll see a large list of file names. You're just looking for the file type and name that matches what you've lost.
Once you find your file, save it to a secure location.
Still can't retrieve or find you missing files?
Try again with a different recovery app.
As said above, Data Rescue II and Stellar Mac Recovery are your best options.
Mac File Recovery
Files are stored on the hard drive at specific locations, and those locations are stored in the file allocation table. When you erase a file, the entry in the allocation table is removed, and the OS now thinks that the space where the file used to be is "free" space - but in actual fact the data is still there.
The problem is that if you save anything on the hard drive, OS X could use that space & overwrite the file or the photos which you want back.
You might have had a chance to retrieve deleted files or deleted photos if you do it immediately, but the longer you leave it, the harder it gets for successful recovery.
