Sometimes the best thing you can do in traffic court is just show up.

Typically, a few people per day escape conviction when they show up and the officer does not.

Far less likely is getting off because you've presented a good defense.

The Californian spent four days watching local traffic court cases recently and only one person out of 20 was able to win by arguing their case.

If the officer shows up, the outcome more likely will hinge on whether the officer jumps through all the hoops that make a traffic ticket valid.

For example, a radar speeding ticket in town requires an officer to prove that the radar gun was set right and working that day. Also the officer in many cases has to show a traffic survey was done at the place of the offense to show the speed limit was properly set.

Traffic Commissioner J.J. Gianquinto estimated that up to 30 percent of trials end with the defendant walking away scot-free.

Mark Handy, 31, was a classic example of this.

"My hope was the officer wouldn't show up," he said. "I got what I was hoping for."

Handy saved $150. He admitted he had no other defense.

FAST TRACK ON SPEEDING TRAFFIC TICKET CASES

If you want to argue your way out of the traffic ticket, you must raise a reasonable doubt, Gianquinto said.

Many people think they can get out of a speeding ticket by arguing that they weren't going as fast as an officer said they were.

The typical argument is, "I wasn't going 82 in the 65 zone. I wasn't going faster than 75."

But Gianquinto said the ticket is for exceeding the speed limit, and admitting to 75 in a 65 zone is exceeding the speed limit.

Marcella Calderon even brought a witness to dispute an officer's contention she was going 92 mph. But both she and the witness admitted she was driving about 70 in a 65 zone, and that was enough for Gianquinto to fine her $300.

Gianquinto said officers have a lot of experience watching speeders and most give pretty good estimates of speed before they even turn on their radar gun.

But what trips officers up sometimes is making sure all the elements needed to prove a case are in order, the commissioner said.

A traffic survey that wasn't done can be fatal to an otherwise legitimate case.

Arguing that an officer was wrong because he didn't use a radar gun doesn't usually work, either.

Esperanza Rodriguiez said CHP Officer Wesley Crisco was simply wrong when he clocked her at 80 mph on Highway 99. She asked for radar proof when she got the traffic ticket.

Judge Pro-tem Alisa Knight backed the officer, fining Rodriguez $146, including the $36 cost of traffic school.

WHAT DID WORK

Kerry Fritz provided photographs and cross-examined Bakersfield Police Officer Jeffrey Paglia in trying to beat a traffic citation for passing at an intersection on 18th Street by Franklin School.

Fritz established a school bus in front of him, lack of a painted crosswalk and the rising sun in his eyes made it impossible for him to see if there was an intersection as he passed the bus.

That met the reasonable doubt standard, Gianquinto said.

Sometimes the victories are partial - a finding of guilt but a reduced fine for a good effort.

Marcelo Rodriguez was cited for passing on the right on College Avenue, where it is a wide road with dash stripes dividing only the east and west lanes.

Rodriguez argued that at one intersection, the eastbound lane has stop printed side by side, indicating two lanes.

Pro-tem Judge Knight found him guilty but, because of his possible confusion, gave him a break on the fine, a total of $161 including $36 for traffic school.

Reducing fines isn't uncommon in traffic court, but often that's up to the judge, Gianquinto said.

What about traffic tickets for talking on a cell phone while driving?

Gianquinto said people who receive a cell phone ticket have offered their cell phone bills to show they had no calls at the time of the ticket. That can raise reasonable doubt, he said.

WHAT DIDN'T WORK

What is the defense to a rolling stop?

Judge Patrick Alderete grinned, saying, "There is no such thing as a rolling stop. If you are rolling, you are not stopped."

How about a red light camera ticket? Judges said they are nearly impossible to beat.

For example, Carlos Torres Cadero didn't help his case when the photos not only showed him running the red light, but talking on a cell phone too. Gianquinto fined him $380.

Defendants have the opportunity to question officers to raise doubts, but when they don't question the officer, the officer's testimony stands, the commissioner said.

So defendants typically give their side, hoping that will work.

"Everybody wants to tell their story," Gianquinto said. "Even when it might be better to be silent."

WASHINGTON - Drivers in their late 50s and early 60s are among the safest on the roads, but motorists who reach retirement age are much more apt to get into an accident, a AAA study finds.

Drivers over 85 were nearly four times as likely to die in a crash as middle-aged drivers, according to the study released Wednesday by the AAA Foundation for Traffic Safety. The study found that as drivers grew older, they increasingly suffered from decreased perception and motor skills. Frailty also caused serious injury and death in crashes that might not kill younger people.

The study also found that the elderly were more likely to get into crashes while turning to the left, when drivers often must make quick judgments about whether to stop or go. Drivers over 65 were 25 percent more likely to get in a crash than middle-aged drivers; drivers over 85 were 50 percent more likely to get in a crash.

Researchers have long suspected that older drivers were more likely to die in crashes, but the study quantifies that, AAA spokesman Mantill Williams said.

Bella Dinh-Zarr, AAA's director of traffic safety, said the study also makes clear that cases like last year's accident at a farmer's market in California, when an elderly man hit and killed 10 people, are anomalies, because seniors statistically are at greatest risk when involved in accidents. The 87-year-old driver in that case survived.

"The common misconception is that older drivers are a danger to others, but the reality is, older drivers are a danger to themselves," Dinh-Zarr said. "As a country, we should really be thinking of ways to help older drivers."

AAA did not recommend new laws to govern elderly drivers. Twenty-two states already have such laws. Florida drivers requires age 80 or older to have their vision checked when they renew their licenses, while New Hampshire and Illinois require road tests for those 75 and older.

AAA said seniors should consider taking specially designed defensive driving courses. Thirty-five states provide insurance discounts for drivers who take such courses. Older drivers also should assess their driving skills regularly along with their doctors, AAA said.

Generally, the DMV offices in southern Orange County have lower failure rates. In Laguna Hills, an average of 25 percent have failed since 2000.

The Register analyzed DMV driving test records from January 2000 to October 2008.

The DMV has not done an in-depth analysis of its pass-fail rates since 1995, spokeswoman Jan Mendoza said, but added that the test is meant to weed out those who are not prepared: "If a person taking the test is not prepared, it's going to be more of a challenge to get through the test. If someone's prepared, they're going to pass the test."

Many factors contribute

Factors such as road conditions, traffic patterns and weather can all contribute to failure rates, Mendoza said.

"No two drive tests are alike," she said. "Every single drive test is so unique it's really hard to pinpoint what's leading to fails."

Rick Correa, a driving instructor and operator of GNG Driving School in Santa Ana, says many of his students have heard about the high failure rate at the Santa Ana office. "This is what I hear - 'I don't want to go to Santa Ana because people don't pass there,'" Correa said.

Instead, many young drivers in the northern part of the county opt for Fullerton, mistakenly thinking it will be easier. Although, Fullerton's failure rate is only slightly lower than Santa Ana's.

The problem, says Correa, is that young drivers unfamiliar with an area outside their own neighborhood are more likely to make mistakes.

"If you know the area of Santa Ana, stay in Santa Ana, why are going to go to an area that you're not familiar with?" Correa said.

"It's not just in Spanish-speaking countries, but also in other parts of the word as well, like in Europe," Correa said. "They're driving on the other side of the road, and introduced to a totally different game here. They've got to understand that the laws here are most strict than in any other country."

DMV officials refused to comment on specific challenges at any of the Orange County offices.

Time behind the wheel

What it comes down to though, Correa says, is practice.

On a recent Monday morning, Correa picked up 15-year-old Justin Peterson, of Tustin, for his second driving lesson.

The two drove mostly on residential streets, Correa reminding the teen to look over his shoulders when making turns and teaching him how to parallel park.

The Foothill High School sophomore's mom, Laurie Peterson, 47, said a family friend took her child to the DMV office in Norco out of concern that the test at the Santa Ana office would be too hard.

Andrew Wunderlich, owner, operator and instructor at Teen Road to Safety in San Juan Capistrano, agrees that practice makes a better driver, but said another problem for young drivers is that most driving schools only teach the bare minimum to pass the test, but not enough techniques in defensive drivingskills.
