Understanding your rental security deposit rights

If anyone has ever been a tenant, chances are they have had issues concerning their security deposit. There always seems to be a dispute concerning its amount and how much should be refunded post move out. In fact, this is one of the most heavily litigated areas of the law, probably due to the fact there are so many renters in California. The rules of the road are often convoluted and misunderstood by tenants. So, instead of reading a giant law book on the subject, why not create a mind map that includes all the important points, dates, and amounts specific to your tenancy. Security Deposits:

Any funds a landlord takes in case the property is damaged.

How much can landlord take?

If for residential property without furniture, may be twice the rent. If furnished, three times the rent. No restriction for commercial property.

Does the deposit have to be returned?

If there is damage to the property, landlord can deduct the cost. But if premise substantially same condition, deposit must be returned. A landlord cannot deduct for painting, new carpets or curtains, unless there was serious damage. Cost of cleaning deductions valid if necessary to put premise back to the same level of cleanliness. Within two weeks of move-out date, landlord must give tenant notice in writing of their right to be present at a walk-through with landlord. This provides the tenant an opportunity to repair damage.

When can I get my deposit back?

A landlord has three weeks to return the security deposit or send a list of how much each of the damages cost including all receipts.

What if landlord keeps too much of deposit?

The landlord must prove the repairs were necessary and reasonable and give receipts for such repairs.

What if the deposit is not returned within three weeks?

You should write a letter to the landlord and explain why you receive your refund.

What if we cannot agree?

File a claim in small claims. You can sue for the deposit amount and in addition, twice the amount of the deposit in damages. You will receive the damages if the landlord acted in bad faith.

What if the rental unit was sold while I was still living there?

Both owners may be held responsible for the deposit.

What if only a roommate is moving out?

If it was the roommate moving out that paid the deposit to the landlord, the landlord returns the deposit.
