Write My Will - Can I change my Will?

Yes, you can.

You need to either write a new Will or sign a document called a Codicil. A Codicil must also be prepared, signed and executed in a certain way. You do not need to rewrite your Will or have a Codicil just because you or a person named in your Will changes their address.

Write My Will - Can I cancel my Will?

Yes.

You may cancel your Will by simply by tearing it up and burning it or by making a new Will.

How does marriage, divorce or a civil partnership affect my Will?

Your Will is cancelled automatically if you get married or enter into a civil partnership after you have signed it, in England, Wales and Northern Ireland. The exception is where the Will contains a sentence stating otherwise, for example, if it had been drawn up just before getting married.

Should you get divorced or your civil partnership is annulled after you have made your Will, then any gifts to your wife, husband or partner will be cancelled, unless the Will stated differently. Your Will would then be read as if they had already died.

It is important that you consider writing a new Will when there are major changes to your situation.

Write My Will - Can my Will be changed after my death?

Something called a "Deed of Variation" may be exercised within two years of death. This allows the terms of a Will to be altered so long as there is the agreement of all the residuary beneficiaries. There might be times where a court makes a judgement. There are some more details in the next question, below, which are important.

The Court can alter your Will should you have not properly provided for any of your dependants who are unable to maintain themselves, or if you have not been fair to your husband, wife or civil partner. This includes an ex-wife or ex-husband who has not remarried.

Your reasons for not having provided for someone should really be given in your Will or in a separate letter, which can be referred to in your Will. The Court will consider these reasons but they will not be bound by them. The situation is different in Scotland - please ask me for details.
