How does marriage, divorce or a civil partnership affect my Will?

Your Will is cancelled automatically if you get married or enter into a civil partnership after you have signed it, in England, Wales and Northern Ireland. The exception is where the Will contains a sentence stating otherwise, for example, if it had been drawn up just before getting married.

Should you get divorced or your civil partnership is annulled after you have made your Will, then any gifts to your wife, husband or partner will be cancelled, unless the Will stated differently. Your Will would then be read as if they had already died.

Something called a "Deed of Variation" may be exercised within two years of death. This allows the terms of a Will to be altered so long as there is the agreement of all the residuary beneficiaries.
