            <description>In todays market home owners are facing a definite challenge to sell their homes because of the vast amount of homes for sale. As we all know defaults and foreclosures are growing rapidly everyday and some people judt didn't know that they could still sell their home even though the value is less than what the mortgage is. In order to have a successful short sale there needs to be a hardship in the sellers life like they lost their job, injury prohibiting them from working, etc. Most banks will begin to negotiate when they know the seller is in default and can't make the payments. They will want to see an offer on the home, the sellers income statements for the past couple of years and most recent pay stubs. Once the offer comes in the bank will ask for the listing agreement and a net sheet to see how much they are possibly losing on the sale of the home. The lender will then perform a bpo or an appraisal so they can get an idea of what they think the home is worth and should sell for. If there is one lender the short sale is that much easier because only one lender at this point needs to approve of the sale. Of course if there are two lenders then they both would need to approve of the sale in order for it to be successful. &amp;nbsp;Once the sell is approved then the lender will normally give you 30 days to close the sell of the home like a normal transaction. Two short sales that I have successfully closed.Date: 15 Sep 2007 When the down market started to take place in the summer of 2006, I had a property listed in Manteca, CA. This home sat on the market with a list price of $455,000 since my seller owed approximately $430,000. I did several open houses and I received a lot of inquiries and walk ins buit no offers. So I decided to look at the local listings in the area and one in particular came up on the market at the time and the owner wanted a quick sale to move into his next property so they priced the home at $409,000, so then I thought ouch how do I break the news to my seller that there is no way we can compete. Luchily I have a broker that's been in the business for 8 years and she told me I should short sale the property. This home did have to loans so the first was getting all of their money but the second was taking a substantial hit. The second happened to be with countrywide. After 3 offers and about 2 weeks to get t he short sale approved we finally closed escrow in October it was relieffor me and the seller and he will not have a foreclosure on his credit and everyone is happy. &amp;nbsp;My second successfully closed short sale was in San Francisco, California. It was a condo that was valued at around $535,000 at the time of the listing agreement. After four months of nothing we definetly had to drop the price, and it took a total of 3 offers to get this closed. This was a big relief because the lender was New Century andduring the middle of one of my offers they said the loan was sold to a private lender, but it was a miswtake and it cost me a buyer because it took 3 weeks to find out they made a mistake. The condo finally sold for $485,000 in July 2007.             <description>My seller and I tried to short sell his home from September 2006 through January 2007. He was in default and we did receive offers that were rejected and of course foreclosed. When we originally listed the property we aimed at trying to get a little under what he paid for to satisfy the first and second lenders. The last offer we received was for $540,000 and the banks refused.

Just a few days ago my seller received a 1099 from his lender in the amount of approximatley $515,000. He has been panicking as you could imagine to have to pay taxes on this amount. I asked all throughout my office from my Broker to other Realtors, CPA's, etc and came up with one word. &quot;Insolvency&quot;

I called the C.A.R. hotline today and spoke to the real estate attorney today and they told me to go to the California Society of Certified Public Accountants (800)922-5272. So I called the number and they told me to log on to http://www.calcpa.org/ and click on public , then click on find a cpa , then click unjder the category niche bankruptcy/insolvency. Then you would have to search under area code or zip code. I thought this was valuable information for a seller that does not want to pay taxes on their foreclosed home.

By the way the home I had listed is currently on the market at $399,000 MLS # 40318024
